【摘要】：有關(guān)正常基線中海圖的效力問題,存在"海圖低潮線優(yōu)先"和"海圖低潮線并不具備當(dāng)然的法律拘束力"兩種意見�；凇堵�(lián)合國海洋法公約》正�；�條款的立法史料以及現(xiàn)公約各文本措辭的梳理,并不能就何種意見更為可取得出清晰結(jié)論,但從公約上下文及國際司法實踐來看,"海圖低潮線并不具備當(dāng)然的法律拘束力"的意見更占優(yōu)勢。具有法律拘束力的基線應(yīng)當(dāng)以實際的基線(低潮線)為準(zhǔn),海圖上的領(lǐng)�；�并不是具有法律拘束力的基線,它是具有法律拘束力的正常基線的一種呈現(xiàn)形式,具備推定的準(zhǔn)確度。但當(dāng)有證據(jù)表明相關(guān)海岸或海洋地物的構(gòu)造發(fā)生明顯的重大變化時,這種推定就是不成立的,而應(yīng)當(dāng)以實際低潮線為準(zhǔn)。
[Abstract]:There are two opinions on the validity of normal baselines: "low tide line priority" and "chart low tide line does not have natural legal binding force". Based on the legislative historical data of the normal baseline provisions of the United Nations Convention on the Law of the Sea and the current wording of each text of the Convention, it is not possible to draw a clear conclusion as to which opinions can be more clearly concluded, but from the perspective of the context of the Convention and international judicial practice, "Chart low tide line does not have the legal binding force of course," the opinion is more dominant. The baselines with legal binding force shall be based on the actual baselines (low tide lines). The baselines of the territorial sea on charts are not legally binding baselines, but are a form of presentation of normal baselines with legal binding force, With presumptive accuracy. But when there is evidence that there is a significant change in the structure of the relevant coastal or marine features, this presumption is not true and should be based on the actual low tide line.
