【摘要】：采用案例分析法等對(duì)國(guó)際體育仲裁院兒童運(yùn)動(dòng)員反興奮劑裁決進(jìn)行分析,以規(guī)范兒童運(yùn)動(dòng)員興奮劑處罰并有效保障兒童權(quán)利。主要結(jié)論:反興奮劑規(guī)則對(duì)兒童運(yùn)動(dòng)員的適用仍應(yīng)堅(jiān)持"嚴(yán)格責(zé)任"的歸責(zé)原則,但在處罰時(shí)也要附條件地考慮到"年齡"和"運(yùn)動(dòng)經(jīng)歷"的特殊因素。建議:在反興奮劑過(guò)程中,增強(qiáng)體育組織保護(hù)兒童權(quán)利的意識(shí),完善實(shí)體標(biāo)準(zhǔn),細(xì)化程序規(guī)定。
[Abstract]:In order to standardize the child athletes' doping punishment and protect children's rights effectively, this paper analyzes the anti-doping ruling of child athletes in the International Sports Arbitration Institute by using case analysis method. Main conclusion: the application of anti-doping rules to child athletes should adhere to the principle of "strict liability", but the special factors of "age" and "sports experience" should also be taken into account in punishment. Suggestions: in the process of anti-doping, we should strengthen the awareness of sports organizations to protect children's rights, perfect the substantive standards, and refine the rules of procedure.
