【摘要】：如何在沒有達(dá)成臨時(shí)安排的情況下,單方面利用爭(zhēng)議海域的油氣資源,是一個(gè)無(wú)法回避的問題。首先,在爭(zhēng)議海域單方面進(jìn)行"臨時(shí)性"勘探和招標(biāo)活動(dòng),是為國(guó)際法所應(yīng)允的。其次,國(guó)際法禁止單方面實(shí)施"非臨時(shí)性"勘探和開采行為。針對(duì)爭(zhēng)端當(dāng)事國(guó)一方違法實(shí)施的"非臨時(shí)性"勘探和開采行為,另一方當(dāng)事國(guó)既可以采取類似行為作為反措施,也可以采取執(zhí)法行動(dòng)制止其違法行為。對(duì)于中國(guó)而言,首先仍要堅(jiān)持共同開發(fā),在此前提下積極進(jìn)行油氣資源勘探,適時(shí)推進(jìn)油氣資源的單方面開采,以及果斷進(jìn)行執(zhí)法。
[Abstract]:How to make use of oil and gas resources unilaterally in the disputed area without an interim arrangement is an unavoidable problem. First, unilateral "temporary" exploration and tendering in the disputed area are permitted under international law. Second, international law prohibits unilateral "non-temporary" exploration and exploitation. In the case of "non-temporary" exploration and exploitation committed illegally by one of the parties to the dispute, the other party may either take a similar act as a countermeasures or take enforcement action to stop the violation. For China, first of all, we should persist in joint development, actively explore oil and gas resources, promote the unilateral exploitation of oil and gas resources in good time, and resolutely enforce the law.
