【摘要】：烏拉圭回合后,WTO各成員通過談判達(dá)成了以《基礎(chǔ)電信協(xié)議》為框架的多邊協(xié)議,全球電信市場得到不斷發(fā)展,世界電信自由化進(jìn)程不斷深化。本文的寫作基于我國加入了WTO并針對電信服務(wù)貿(mào)易所做的承諾,分析國際電信服務(wù)貿(mào)易的相關(guān)法律規(guī)制。結(jié)合WTO專家組對電信服務(wù)貿(mào)易第一案一墨美電信案的解讀,具體分析我國電信服務(wù)發(fā)展的現(xiàn)狀和方向,最后依據(jù)我國的“入世”電信服務(wù)承諾,對我國電信服務(wù)市場存在的問題提出應(yīng)對之策。 本文主要分四個(gè)部分：第一部分介紹了電信服務(wù)貿(mào)易的相關(guān)概念、特征和世界電信服務(wù)發(fā)展概況。第二部分分析了國際電信服務(wù)貿(mào)易的相關(guān)法律規(guī)制。國際電信服務(wù)貿(mào)易是由一系列的協(xié)議所組成,主要包括《服務(wù)貿(mào)易總協(xié)定》、《服務(wù)貿(mào)易總協(xié)定電信服務(wù)附件》、《GATS第四議定書》(《基礎(chǔ)電信協(xié)議》)及各國的承諾表、豁免和《關(guān)于電信管理準(zhǔn)則的參考文件》等。第三部分根據(jù)上述相關(guān)協(xié)議,重點(diǎn)介紹了電信服務(wù)貿(mào)易的市場準(zhǔn)入、互聯(lián)互通和競爭保障等主要規(guī)則并結(jié)合墨美電信案分析該案所涉及的上述相關(guān)規(guī)則。第四部分針對我國電信業(yè)發(fā)展過程中存在的問題和我國對于電信服務(wù)所做的承諾,提出我國電信改革發(fā)展的方向和應(yīng)對之策。
[Abstract]:After the Uruguay Round, the members of the WTO reached a multilateral agreement based on the basic Telecommunication Agreement through negotiation. The global telecommunications market was continuously developed and the liberalization process of the world telecommunications was deepened. Based on China's accession to WTO and its commitment to trade in telecommunications services, this paper analyzes the relevant legal regulations of international trade in telecommunications services. Combined with the interpretation of the WTO expert group on the first case of telecommunication service trade-the case of Mexico and America Telecom, this paper analyzes the present situation and direction of the development of telecommunication service in China, and finally, according to the promise of telecommunication service of our country, This paper puts forward some countermeasures to the problems existing in China's telecom service market. This paper is divided into four parts: the first part introduces the related concepts, characteristics and the development of telecom services in the world. The second part analyzes the relevant legal regulation of international telecommunication service trade. International trade in telecommunications services consists of a series of agreements, including the General Agreement on Trade in Services (GATS), the GATS Annex on Telecommunications Services (GATS), the fourth Protocol of the General Agreement on GATS (basic Telecommunications Agreement) and the list of commitments of various countries. Exemption and reference document on Telecommunications Regulation Code, etc. The third part mainly introduces the main rules of market access, interconnection and competition protection of telecommunication services trade according to the above relevant agreements, and analyzes the relevant rules involved in this case in the light of the case of M & M Telecom. In the fourth part, aiming at the problems existing in the development of China's telecom industry and the commitment made by our country to the telecommunication service, the author puts forward the direction and countermeasures for the reform and development of China's telecommunications industry.
