【摘要】：環(huán)保專利共享計(jì)劃是氣候變化相關(guān)技術(shù)轉(zhuǎn)讓機(jī)制的重要組成部分,它從私人公司的角度出發(fā)為氣候變化相關(guān)技術(shù)轉(zhuǎn)讓的問題提出了新的視角,利用環(huán)保技術(shù)的特性建立起私人自愿捐贈機(jī)制,在促進(jìn)技術(shù)創(chuàng)新的同時實(shí)現(xiàn)有效的技術(shù)轉(zhuǎn)讓。國際環(huán)境條約為環(huán)保專利共享計(jì)劃提供了法律依據(jù),環(huán)保技術(shù)與軟件的相似性為環(huán)保專利共享計(jì)劃提供了可行性基礎(chǔ),專利和契約等相關(guān)法律制度的完善為環(huán)保專利共享計(jì)劃的運(yùn)行提供了法律保障。
[Abstract]:The environmental patent sharing scheme, an important component of the climate change-related technology transfer mechanism, offers a new perspective on climate change-related technology transfer from the perspective of private companies. The mechanism of private voluntary donation is established by using the characteristics of environmental protection technology to promote technological innovation and realize effective technology transfer at the same time. The international environmental treaties provide the legal basis for the environmental protection patent sharing plan, and the similarity between the environmental protection technology and the software provides the feasible foundation for the environmental protection patent sharing plan. The improvement of patent and contract legal system provides legal guarantee for the operation of environmental protection patent sharing plan.
