【摘要】：協(xié)同行為是卡特爾的一種表現(xiàn)形式。認(rèn)定協(xié)同行為需要證實(shí)當(dāng)事人之間存在意思上的聯(lián)絡(luò)、由意思聯(lián)絡(luò)而達(dá)成的市場(chǎng)上的一致行為以及意思聯(lián)絡(luò)與一致行為之間的因果關(guān)系。由于無(wú)法輕易得到直接證據(jù),競(jìng)爭(zhēng)執(zhí)法機(jī)構(gòu)往往要依靠充分的間接證據(jù)證明存在協(xié)同行為。在香蕉卡特爾案中,歐盟委員會(huì)認(rèn)定經(jīng)銷(xiāo)商在行情價(jià)格確定前一天通過(guò)電話進(jìn)行溝通,從而對(duì)香蕉的參考行情價(jià)格進(jìn)行協(xié)調(diào),構(gòu)成了反競(jìng)爭(zhēng)的協(xié)同行為。該案對(duì)理解協(xié)同行為具有一定的借鑒意義。
[Abstract]:Synergistic behavior is a form of cartel. It is necessary to confirm the existence of the meaning connection between the parties, the consistent behavior in the market reached by the will liaison, and the causality between the intention liaison and the consistent behavior. Since direct evidence is not readily available, competition enforcement agencies often rely on sufficient circumstantial evidence to prove synergy. In the banana cartel case, the European Commission found that dealers communicated by telephone the day before the market price was set, thus coordinating the reference prices of bananas, which constituted an anti-competitive synergistic act. This case has certain reference significance to understand the synergetic behavior.
