【摘要】：領(lǐng)事保護(hù)是國(guó)際法的一個(gè)特殊問(wèn)題,也是國(guó)家間關(guān)系的一項(xiàng)重要內(nèi)容。領(lǐng)事保護(hù)法律問(wèn)題,目前無(wú)論在國(guó)內(nèi)還是在國(guó)外,相關(guān)研究都處在一個(gè)起始階段。伴隨著各國(guó)之間國(guó)際交往的不斷加深,領(lǐng)事保護(hù)問(wèn)題日益重要,無(wú)論是在政府實(shí)踐上還是在學(xué)術(shù)研究上都應(yīng)引起足夠的重視,然而時(shí)至今日,對(duì)于領(lǐng)事保護(hù)法律問(wèn)題進(jìn)行全面闡釋的文章并不多見(jiàn)。因此,本論文寫(xiě)作的主要目的在于從宏觀上對(duì)領(lǐng)事保護(hù)的基本法律問(wèn)題做一些分析,來(lái)探求中國(guó)領(lǐng)事保護(hù)法律制度在完善過(guò)程中所遇到的實(shí)際問(wèn)題與解決途徑。 領(lǐng)事保護(hù)制度起源于中世紀(jì)的歐洲,曾經(jīng)復(fù)興之后,一度衰落,直到《維也納領(lǐng)事關(guān)系公約》的出現(xiàn),領(lǐng)事保護(hù)制度再次受到國(guó)際社會(huì)的普遍關(guān)注。國(guó)際法“人本化”趨向下,領(lǐng)事保護(hù)不僅是一項(xiàng)國(guó)家權(quán)利與責(zé)任,也是一項(xiàng)個(gè)人權(quán)利,領(lǐng)事服務(wù)的效果也成為衡量外交部領(lǐng)導(dǎo)人和駐外使領(lǐng)館館長(zhǎng)們工作成績(jī)的重要指標(biāo),決定著民眾和媒體對(duì)一個(gè)國(guó)家綜合國(guó)力的評(píng)價(jià)。我國(guó)的領(lǐng)保工作不可避免的會(huì)遇到一些行政或法律上的障礙,應(yīng)當(dāng)根據(jù)形勢(shì)發(fā)展的需要不斷加以調(diào)整完善,以提高我國(guó)政府保護(hù)海外華人利益的能力與成效。所以,加強(qiáng)對(duì)領(lǐng)事保護(hù)相關(guān)法律問(wèn)題的研究是十分必要和緊迫的。 本論文在結(jié)構(gòu)上分為引言、正文和結(jié)論三個(gè)部分。其中,正文部分分為四章。 正文分別介紹了領(lǐng)事保護(hù)的基礎(chǔ)理論,領(lǐng)事保護(hù)的現(xiàn)狀,我國(guó)現(xiàn)行領(lǐng)事保護(hù)制度存在的主要問(wèn)題及對(duì)策。 結(jié)論部分對(duì)行文進(jìn)行總結(jié)并再現(xiàn)提出領(lǐng)事保護(hù)基本法律問(wèn)題的重要性。
[Abstract]:Consular protection is a special problem in international law and also an important part of inter-state relations. At present, the legal issues of consular protection are at an initial stage, both at home and abroad. With the deepening of international exchanges between countries, the issue of consular protection is becoming increasingly important, both in government practice and academic research should be paid enough attention to, but today, There are few articles explaining the legal issues of consular protection in a comprehensive way. Therefore, the main purpose of this thesis is to make some analysis on the basic legal problems of consular protection from the macro point of view, to explore the practical problems encountered in the process of perfecting the legal system of consular protection in China and the ways to solve them. The system of consular protection originated in medieval Europe and declined after it was revived until the appearance of the Vienna Convention on Consular Relations. The system of consular protection has once again received widespread concern from the international community. Under the trend of "humanization" of international law, consular protection is not only a national right and responsibility, but also a personal right. The effectiveness of consular services has also become an important indicator of the achievements of the foreign ministry leaders and the heads of embassies and consulates stationed abroad. Determines the people and the media to a country's comprehensive national strength evaluation. The work of obtaining insurance in our country will inevitably meet some administrative or legal obstacles, which should be adjusted and perfected constantly according to the needs of the development of the situation in order to improve the ability and effect of our government to protect the interests of overseas Chinese. Therefore, it is very necessary and urgent to strengthen the study on the legal issues related to consular protection. The structure of this paper is divided into three parts: introduction, text and conclusion. Among them, the text part is divided into four chapters. The text introduces the basic theory of consular protection, the status quo of consular protection, the main problems and countermeasures of the current consular protection system in China. The conclusion part summarizes the text and reappears the importance of putting forward the basic legal issues of consular protection.
