【摘要】：中國曾根據(jù)《聯(lián)合國海洋法公約》所允許的保留就涉及海洋劃界、領(lǐng)土歸屬、軍事活動等爭端做出了排除將上述爭端提交國際強(qiáng)制程序的保留。盡管菲律賓堅(jiān)稱其向仲裁法庭提交請求裁決的13個訴求都不屬于中國聲明保留的范圍,但事實(shí)上都屬于海洋劃界和島礁領(lǐng)土歸屬爭端。菲律賓無權(quán)單方提交導(dǎo)致有拘束力裁判的強(qiáng)制程序,仲裁法庭也不應(yīng)確立對本案的管轄權(quán)。
[Abstract]:According to the UN Convention on the Law of the Sea, China has made reservations on disputes relating to maritime delimitation, territorial attribution, military activities and other disputes that exclude the submission of such disputes to international compulsory procedures. While the Philippines maintains that none of its 13 claims to the arbitral tribunal fall within the scope of China's declaration of reservation, they are in fact maritime delimitation and territorial disputes over reefs. The Philippines is not entitled to submit ex parte compulsory proceedings leading to binding decisions, nor should the arbitral tribunal establish jurisdiction in the case.
