【摘要】：中國(guó)的經(jīng)濟(jì)發(fā)展迅速，飛速發(fā)展的經(jīng)濟(jì)需要消耗大量的能源，這使得我國(guó)成為了能源進(jìn)口大國(guó)。目前，我國(guó)已經(jīng)一躍成為世界第一大石油進(jìn)口國(guó)和消費(fèi)國(guó)。海船運(yùn)輸?shù)姆绞綖閲?guó)內(nèi)提供了大量的進(jìn)口石油的同時(shí)，沿海時(shí)有發(fā)生的油污事故所造成的損失也是難以忽視的。因此，在我國(guó)內(nèi)地既沒有加入任何基金公約也沒有專門的油污損害賠償?shù)南嚓P(guān)立法的背景下，一旦發(fā)生船舶油污事故，油污受害人的索賠要求將很難得到滿足。本文旨在分析建立合乎我國(guó)國(guó)情的船舶油污損害賠償基金制度，并借鑒國(guó)際上主要的基金立法模式，以期更好地完善我國(guó)的相關(guān)制度。 本文除序言與結(jié)語外，主體部分包括四章。 第一章：船舶油污損害賠償制度概述，對(duì)國(guó)際公約船舶油污損害賠償體系、油污損害賠償基金及其相關(guān)制度、我國(guó)船舶油污損害賠償制度現(xiàn)狀等問題作了總體論述。 第二章：我國(guó)建立船舶油污損害賠償基金制度的現(xiàn)實(shí)考量，具體分析了我國(guó)現(xiàn)階段不適宜加入《基金公約》的緣由，論證我國(guó)當(dāng)前急需建立國(guó)內(nèi)油污基金制度，，建立我國(guó)自己的油污基金制度的必要性和可行性。 第三章：《船舶油污損害賠償基金征收和使用管理辦法》解讀和評(píng)價(jià)，涉及我國(guó)船舶油污損害賠償基金的性質(zhì)、適用的油類和船舶類型、賠償范圍、賠償順序、索賠時(shí)效、賠償限額、組織機(jī)構(gòu)、完善《管理辦法》的建議等角度。 第四章：國(guó)際上主要的油污損害賠償基金模式對(duì)我國(guó)的啟示，介紹了國(guó)際上主要的油污基金模式，引出我國(guó)船舶油污損害賠償基金的發(fā)展方向和模式選擇，提出我國(guó)建立“雙基金”模式的設(shè)想。
[Abstract]:China's economy is developing rapidly, and the rapid development of economy needs a lot of energy consumption, which makes China become a large energy importing country. At present, China has become the world's largest oil importer and consumer. At the same time, it is difficult to ignore the loss caused by the oil pollution accidents that occur in the coastal areas. Therefore, under the background that the mainland of our country has neither acceded to any fund convention nor has special legislation on compensation for oil pollution damage, once a ship oil pollution accident occurs, it will be difficult to satisfy the claims of the oil pollution victims. The purpose of this paper is to analyze and establish the system of compensation fund for oil pollution damage of ships in accordance with the national conditions of our country, and to draw lessons from the main legislative models of international funds in order to perfect the relevant system of our country better. In addition to the preface and conclusion, the main part consists of four chapters. The first chapter is an overview of the compensation system for oil pollution damage from ships, including the system of compensation for oil pollution damage from ships under international conventions, the compensation fund for oil pollution damage and its related systems, and the present situation of the compensation system for oil pollution damage on ships in China. Chapter two: the realistic consideration of establishing the compensation fund system of ship oil pollution damage in our country, the reason why our country is not suitable to join the fund convention at the present stage is analyzed concretely, and it is proved that our country urgently needs to establish the domestic oil pollution fund system at present. The necessity and feasibility of establishing our own oil pollution fund system. Chapter III: "measures for the Administration of the Collection and use of the compensation Fund for Oil pollution damage from ships", which involves the nature of the Oil pollution compensation Fund for ships in China, the types of oil and ships applicable, the scope of compensation, the order of compensation, the limitation of claims, Compensation limit, organization, suggestion of perfecting management measures, etc. The fourth chapter: the main international oil pollution damage compensation fund model to our country enlightenment, introduced the international main oil pollution fund pattern, drew our country ship oil pollution damage compensation fund development direction and the pattern choice, This paper puts forward the idea of establishing "double fund" mode in our country.
