【摘要】：在全球一體化的當(dāng)今社會,經(jīng)濟(jì)迅速發(fā)展,國際社會將追求國際法治作為發(fā)展國際法的一個(gè)重要目標(biāo)。有關(guān)條約的解釋也就變得十分重要了,這篇文章是通過把目的解釋方法以及相關(guān)作為主線,并且結(jié)合其他解釋方法作為補(bǔ)充的格局進(jìn)行條約目的解釋的研究。本文是通過四個(gè)方面進(jìn)行目的解釋方法的框架構(gòu)建：第一,條約的目的和目的解釋。首先對條約的目的這一概念進(jìn)行介紹,其次說明在締結(jié)條約時(shí)確立締結(jié)目的需要注意的問題,從而進(jìn)行條約目的解釋的有關(guān)闡述。條約的目的解釋是關(guān)于條約的目標(biāo)和主旨的解釋,屬于條約適當(dāng)性的保障。第二,條約目的解釋的關(guān)鍵性以及相關(guān)。這部分是介紹了條約解釋中文本解釋的局限性、條約目的解釋方法的法律依據(jù)和目的解釋方法在條約解釋中的地位。雖然文本解釋是條約解釋常用的解釋方法,但是也是具有一定的局限性,目的解釋等解釋方法能很好地彌補(bǔ)其缺陷。目的解釋是以《維也納條約法公約》作為基礎(chǔ)的法律依據(jù)的,并且以此發(fā)散出其他依據(jù)。作為一種動態(tài)的解釋方法,目的解釋在條約解釋中的作用越來越被強(qiáng)化,可以在進(jìn)行條約解釋的時(shí)候補(bǔ)充文本解釋,也可以界定系統(tǒng)解釋的上下文范圍,還可以協(xié)助澄清不同的協(xié)定所產(chǎn)生的相異關(guān)系。第三,目的解釋在實(shí)踐中的表現(xiàn)。目的解釋不僅在一般的國際法實(shí)踐中有重要作用,在解決世貿(mào)爭端中也是十分重要的。本文從兩個(gè)方面進(jìn)行介紹：1、實(shí)體層面的應(yīng)用。2、程序?qū)用娴膽?yīng)用。第四,目的解釋的規(guī)范化。目的解釋方法雖然是一個(gè)重要的條約解釋力法,具有較大的自由裁量權(quán),同時(shí)文本解釋等解釋方法的局限性又為目的解釋方法的應(yīng)用創(chuàng)造了條件,但是在實(shí)踐中具體的條約條款中也有廣泛適用目的解釋方法行不通的情況,如果一味地盲目使用可能會出現(xiàn)條約解釋的“副作用”,所以對其進(jìn)行規(guī)范化矯正就變得十分重要了。矯正方式主要為：1、控制司法能動主義的使用,堅(jiān)持目的解釋方法和文本解釋方法之間的均衡。2、避免過分依賴目的解釋方式。3、避免極度的目的解釋詮釋。 綜上本文是希望通過對目的解釋方法的探究,更清楚地了解目的解釋方法在整個(gè)條約解釋實(shí)踐中的重要存在意義,從而使它發(fā)揮更長遠(yuǎn)的作用。
[Abstract]:With the rapid development of global economy, international society regards the pursuit of international rule of law as an important goal in the development of international law. The interpretation of the treaty becomes very important. This article studies the interpretation of the purpose of the treaty by taking the Skopos interpretation method and the correlation as the main line, and combining the other interpretation methods as the supplementary pattern. This paper constructs the framework of the purpose interpretation method in four aspects: first, the purpose and purpose interpretation of the treaty. This paper first introduces the concept of the purpose of the treaty, and then explains the problems that need to be paid attention to when establishing the purpose of the conclusion of the treaty, so as to make the relevant exposition of the interpretation of the purpose of the treaty. The purpose interpretation of a treaty is the interpretation of the object and purpose of the treaty and is a guarantee of its appropriateness. Second, the key and relevance of the interpretation of the purpose of the treaty. This part introduces the limitation of the interpretation of the Chinese text of the treaty interpretation, the legal basis of the interpretation method of the purpose of the treaty and the position of the method of interpretation of the purpose in the interpretation of the treaty. Although text interpretation is a common interpretation method of treaty interpretation, it also has some limitations. The purpose of interpretation is based on the Vienna Convention on the Law of treaties. As a dynamic method of interpretation, the role of purpose interpretation in treaty interpretation is becoming more and more intensive, which can be supplemented by textual interpretation in the interpretation of treaties, and the context of systematic interpretation can also be defined. It can also help to clarify differences arising from different agreements. Third, the purpose explains the performance in practice. Objective interpretation plays an important role not only in the practice of international law, but also in the settlement of WTO disputes. This paper introduces two aspects: the application of: 1, the application of entity level, the application of program level. Fourth, the standardization of purpose interpretation. Although the method of purpose interpretation is an important method of treaty interpretation, it has great discretion. At the same time, the limitation of interpretation methods, such as text interpretation, creates conditions for the application of the method of purpose interpretation. However, in practice, there are also cases in which the method of purpose interpretation is not widely applicable in specific treaty clauses. If blindly used blindly, there may be "side effects" of treaty interpretation. So it is very important to normalize the correction. The correction is mainly in the form of "1: 1", which controls the use of judicial activism, insists on the balance between the purpose interpretation method and the text interpretation method, avoids relying too much on the purpose interpretation mode .3and avoids the extreme teleological interpretation. The purpose of this paper is to understand clearly the significance of the purpose interpretation method in the whole treaty interpretation practice, so as to make it play a more long-term role.
