【摘要】：跨國(guó)地下水是國(guó)際水域的重要組成部分�？鐕�(guó)地下水本身的特點(diǎn)需要制定適合其特性的專(zhuān)門(mén)法規(guī)。從20世紀(jì)20年代到現(xiàn)在,逐漸形成了一系列跨國(guó)地下水開(kāi)發(fā)利用的條約和規(guī)則,這些條約和規(guī)則對(duì)跨國(guó)地下水的開(kāi)發(fā)利用和保護(hù)具有一定的積極意義。但是,由于在確定地下水的法律制度方面,有一系列理論問(wèn)題尚未受到重視,因此,關(guān)于跨國(guó)地下水現(xiàn)有的立法存在一定缺陷。制定公平和合理利用跨國(guó)地下水資源的雙邊和多邊條約、重視跨國(guó)地下水與地表水的整體性、建立專(zhuān)門(mén)的跨國(guó)地下水管理組織規(guī)范等是完善跨國(guó)地下水立法的重要內(nèi)容。
[Abstract]:Transnational groundwater is an important part of international waters. The characteristics of transnational groundwater require special regulations suitable for its characteristics. From the 1920s to the present, a series of treaties and rules on the exploitation and utilization of transnational groundwater have been gradually formed. These treaties and rules have certain positive significance for the exploitation and protection of transnational groundwater. However, due to the fact that a series of theoretical problems have not been paid attention to in determining the legal system of groundwater, there are some defects in the existing legislation on transnational groundwater. It is important to make bilateral and multilateral treaties to make fair and reasonable use of transnational groundwater resources, to attach importance to the integrity of transnational groundwater and surface water, and to establish special organizational norms for transnational groundwater management.
