國際法視野中的傳染病防治與合作

【摘要】：隨著世界各國經(jīng)濟(jì)步伐的加快,全球化成為必然,不只是經(jīng)濟(jì)、政治的全球化,傳染病亦成為了全球關(guān)注的焦點(diǎn)。隨著交通業(yè)的日益發(fā)達(dá),人口流動迅速加快,跨界活動增多,生態(tài)環(huán)境日益惡化,傳染病全球化特征日益明顯,這正是我們國際傳染病防治與合作的主要原因。城市的擴(kuò)展,農(nóng)村城市化的興起,全球化范圍的人員和物資的流動,高級抗生素造就的超級耐藥細(xì)菌和病毒都給當(dāng)今傳染病的國際防治帶來了新的難題,人類的種種行為正在為像鼠疫這樣“作古”了的病毒提供著各種新的機(jī)會。加強(qiáng)國際傳染病的防治與合作,利用國際法有效的保護(hù)、促進(jìn)這種合作的順利進(jìn)行勢在必行。 從目前國際立法和我國國內(nèi)法來看,國際立法中沒有完整的一部傳染病防治法,大多的只是間接涉及該問題；而我國國內(nèi)雖然有專門的傳染病防治法,但仍然存在著諸多問題,仍需進(jìn)一步完善。因此,加強(qiáng)傳染病防治與合作的國際法方面研究就成為了重點(diǎn),為了彌補(bǔ)研究的空白,加強(qiáng)我國參與國際傳染病防治與合作的力度,對國際傳染病的防治與合作的研究有其重要性和特殊性。 本文主要是從國際法和中國國內(nèi)法兩方面分析論述當(dāng)前國際傳染病防治與合作的現(xiàn)狀、缺陷和不足,并提出了進(jìn)一步完善的建議。本文突出的創(chuàng)新點(diǎn)是將傳染病防治的國際合作問題與人權(quán)保護(hù)相銜接,揭示了國際立法與中國國內(nèi)立法中對人權(quán)保護(hù)的必要性。 筆者的寫作思路大體如下：首先,從國際傳染病防治與合作的原因指出必須進(jìn)行國際合作；其次,以《國際衛(wèi)生條例(2005)》與《國際衛(wèi)生條例(1969)》相比,闡述國際立法對傳染病防治的新發(fā)展以及國際環(huán)境法與傳染病防治的關(guān)系,同時(shí)闡明中國在“非典”后對傳染病防治法的完善；再次,從國際立法和中國國內(nèi)法角度論述在傳染病防治過程中的人權(quán)保護(hù)問題；最后,強(qiáng)調(diào)我國應(yīng)當(dāng)積極加入到國際傳染病的防治與合作中來,并分析其原因,對我國國內(nèi)法目前傳染病防治方面存在的問題加以闡述,進(jìn)而提出進(jìn)一步加強(qiáng)國際傳染病防治與合作的意見。 本文序言部分對國際傳染病防治與合作的現(xiàn)狀作了簡要的引述。介紹了國際傳染病的緣起,闡述了傳染病防治與合作的重要意義以及立法規(guī)制的必要性、緊迫性。 本文正文部分主要分為四個部分。首先,介紹了國際傳染病防治與合作概述,詳盡闡述了國際傳染病防治與合作的原因,總結(jié)了當(dāng)前傳染病的全球化應(yīng)對方式,深刻分析了國際傳染病防治與合作的必要性。 接著,在與前一部分理論分析承接的基礎(chǔ)上,本文對目前國際上與傳染病防治相關(guān)的主要法律進(jìn)行了分析,介紹了它們的起源、發(fā)展以及存在的缺陷。通過分析這些相關(guān)法律,深刻剖析中外在國際傳染病防治與合作法律制度方面的不足,為如何更好的運(yùn)用法律手段對傳染病進(jìn)行合理防治提供依據(jù)。 正是由于國際傳染病防治與合作的過程中存在著諸多問題。因此,本文第三部分重點(diǎn)介紹了目前國際傳染病防治與合作中存在的主要問題,通過對比國際和中國對該問題的解決現(xiàn)狀闡釋了進(jìn)一步完善國際傳染病防治與合作在此方面規(guī)定的必要性。 最后,本文對構(gòu)建我國傳染病防治與國際合作進(jìn)行了設(shè)想。總結(jié)了適于我國國情的傳染病防治措施,在分析了我國積極參加國際傳染病防治與合作的必要性的基礎(chǔ)上揭示了當(dāng)前我國在傳染病防治領(lǐng)域中存在的問題,提出了健全我國參與國際傳染病防治與合作措施的建議。
[Abstract]:With the rapid economic pace of all countries in the world, globalization is inevitable, not only economic, political globalization, and infectious diseases have also become the focus of global attention. With the increasing development of the transportation industry, the population flow is quickening, the cross-border activities are increasing, the ecological environment is worsening, and the globalization of infectious diseases is becoming more and more obvious, which is our international The main reasons for the prevention and cooperation of infectious diseases, the expansion of the city, the rise of rural urbanization, the flow of people and materials in the global scope, the super antibiotic resistant bacteria and viruses made by advanced antibiotics have brought new problems to the international prevention and control of today's infectious diseases, and the species behavior of human beings is being "ancient" like the plague. It provides all kinds of new opportunities. Strengthening the prevention and cooperation of international infectious diseases, utilizing effective protection of international law and promoting the smooth progress of such cooperation are imperative.
From the current international legislation and China's domestic law, there is not a complete law of prevention and control of infectious diseases in international legislation, most of which are only indirectly related to the problem; although there are special prevention and control laws of infectious diseases in China, there are still many problems and still need to be further improved. Therefore, the international law of prevention and cooperation of infectious diseases should be strengthened. Face research has become the key point. In order to make up the blank of the research, strengthen our country's participation in the prevention and control and cooperation of international infectious diseases, and the study of the prevention and cooperation of international infectious diseases is of its importance and particularity.
This article is mainly from the two aspects of international law and China's domestic law to analyze the current situation, defects and shortcomings of the prevention and cooperation of international communicable diseases, and put forward some suggestions for further improvement. The innovation point of this article is to link the international cooperation with the prevention of infectious diseases with the protection of human rights, and to reveal the international legislation and the domestic legislation in China.
