試論TPP勞工標(biāo)準(zhǔn)、其影響及中國的應(yīng)對(duì)策略

【摘要】:2016年2月4日,TPP協(xié)定由12個(gè)成員國正式簽署,目前正處于批準(zhǔn)階段。TPP勞工標(biāo)準(zhǔn)的最大特征是具有可強(qiáng)制執(zhí)行力,適用磋商基礎(chǔ)上的強(qiáng)制性爭端解決機(jī)制,以貿(mào)易制裁或經(jīng)濟(jì)制裁為后盾,這意味著任何勞工爭端最終都會(huì)延伸為貿(mào)易糾紛問題。雖然中國尚未加入TPP,但TPP勞工標(biāo)準(zhǔn)實(shí)施后的擴(kuò)大適用給我國帶來的負(fù)面影響應(yīng)引起我國高度重視并應(yīng)分別在微觀、中觀和宏觀層面上采取應(yīng)對(duì)措施,以防患于未然、更好地保護(hù)我國經(jīng)濟(jì)和貿(mào)易利益。
[Abstract]:The TPP agreement, which was formally signed by 12 member States on 4 February 2016, is in the process of being ratified. The greatest feature of the TPP labour standard is that it is enforceable and applies a compulsory dispute settlement mechanism based on consultations. Backed by trade or economic sanctions, any labor dispute will eventually extend to trade disputes. Although China is not yet a member of the TPPP, the negative impact of the expanded application of the TPP labor standards on China should be highly valued and countermeasures should be taken at the micro, meso and macro levels, respectively, in order to prevent trouble from happening in the first place. Better protect China's economic and trade interests.
