【摘要】：作為中華民族傳統(tǒng)文化精華的中醫(yī)藥,在保障我國古代人民的繁衍昌盛以及文化交流方面做出了不可磨滅的作用。但到了近代,作為我國獨(dú)創(chuàng)的中醫(yī)藥,由于頻頻遭遇國外市場的貿(mào)易壁壘,在出口國外市場方面遭遇了極大的障礙,造成出口額較少,國際市場占有率較低的窘境。 本文分四個章節(jié)來分別闡述了wTO技術(shù)性貿(mào)易壁壘規(guī)則,我國中藥出口遭遇的技術(shù)性貿(mào)易壁壘以及從法律角度的應(yīng)對策略。其中第一章闡述了我國中藥出口遭遇的技術(shù)性貿(mào)易壁壘,包括我國中藥出口遭遇的技術(shù)性貿(mào)易壁壘的主要形式以及對我國中藥出口造成的影響.介紹了wTO規(guī)則中有關(guān)技術(shù)性貿(mào)易壁壘的法律規(guī)則,主要包括《技術(shù)性貿(mào)易壁壘協(xié)議》和《實(shí)施衛(wèi)生和動植物檢疫措施協(xié)議》；在本文第二章詳細(xì)介紹了我國和我國主要出口市場的植物藥監(jiān)管體制,鑒于歐盟市場和美國市場具有巨大的市場容量和較為嚴(yán)格的植物藥管理體系,本文著重分析了歐盟的《傳統(tǒng)植物藥注冊程序指令》以及美國植物藥的上市申請方式；本文第三章主要闡述了中藥技術(shù)性貿(mào)易壁壘的影響和成因分析,并分析了我國中藥產(chǎn)業(yè)存在的主要問題；最后一章闡述了應(yīng)對中藥技術(shù)性貿(mào)易壁壘的策略,重點(diǎn)從法律角度給出了自己的建議。
[Abstract]:As the essence of Chinese traditional culture, Chinese medicine plays an indelible role in ensuring the prosperity of ancient Chinese people and cultural exchange. But in modern times, as the original Chinese medicine of our country, because of frequently encountered the foreign market trade barrier, has encountered the enormous barrier in the export foreign market aspect, causes the export volume to be small, the international market share is low the predicament. This article is divided into four chapters to explain the rules of WTO TBT, the TBT encountered by Chinese traditional medicine export and the countermeasures from the legal point of view. The first chapter describes the technical barriers to trade encountered by Chinese traditional medicine exports, including the main forms of technical trade barriers encountered by Chinese traditional medicine exports and the impact on Chinese traditional medicine exports. This paper introduces the legal rules of technical barriers to trade (TBT) in the WTO rules, including the Agreement on Technical barriers to Trade (TBT) and the Agreement on the implementation of Sanitary and Phytosanitary measures (SPS). In the second chapter of this paper, we introduce in detail the regulatory system of vegetable drugs in our country and our main export markets. In view of the huge market capacity and strict management system of plant drugs in the European Union market and the American market, This paper focuses on the European Union's "traditional Plant Drug Registration procedure Directive" and the application for the listing of American plant drugs. The third chapter mainly describes the impact and causes of the TBT of traditional Chinese medicine. In the last chapter, the strategies to deal with the TBT of traditional Chinese medicine are discussed, and some suggestions are put forward from the point of view of law.
