【摘要】："國(guó)際法淵源"雖是條約明文規(guī)定的法律概念,但條約并未規(guī)定其定義。國(guó)際法淵源用以確認(rèn)國(guó)際法規(guī)范的現(xiàn)實(shí)存在及其法律效力,旨在準(zhǔn)確地運(yùn)用國(guó)際法原則和規(guī)則解決國(guó)際爭(zhēng)端。縱觀國(guó)際法權(quán)威學(xué)家們關(guān)于國(guó)際法淵源概念的論述,關(guān)于國(guó)際法淵源的外延,觀點(diǎn)幾乎一致;而對(duì)國(guó)際法淵源的定義,卻迥然各異。有的以"法律淵源"定義國(guó)際法淵源,混淆了國(guó)內(nèi)法淵源與國(guó)際法淵源的區(qū)別;有的提出了簡(jiǎn)明的國(guó)際法淵源概念,但又作了自我否定;有的以分類的方法定義國(guó)際法淵源,反而使國(guó)際法淵源的定義陷入矛盾中。國(guó)際法淵源的定義在國(guó)際法學(xué)界已形成一大理論誤區(qū),是故,科學(xué)地定義國(guó)際法淵源,對(duì)于國(guó)際法理論和實(shí)踐而言都具有重大的現(xiàn)實(shí)意義。國(guó)際法淵源是指確定國(guó)際法原則和規(guī)則的現(xiàn)實(shí)存在及其法律效力的表現(xiàn)形式,這些表現(xiàn)形式就是條約、國(guó)際習(xí)慣和一般法律原則。這一概念揭示了國(guó)際法淵源的本質(zhì)特征,實(shí)現(xiàn)了國(guó)際法淵源的內(nèi)涵與外延的統(tǒng)一。在國(guó)際法實(shí)踐中,條約、國(guó)際習(xí)慣和一般法律原則這三種不同形式的國(guó)際法的淵源用以確認(rèn)國(guó)際法規(guī)范存在和效力的方法各有不同。
[Abstract]:Although "source of international law" is an explicit legal concept in a treaty, it is not defined in a treaty. The sources of international law are used to confirm the existence and legal effect of the norms of international law and to use the principles and rules of international law accurately to settle international disputes. Throughout the discussion of the concept of the sources of international law by the authoritative experts of international law, the views on the extension of the sources of international law are almost identical, but the definitions of the sources of international law are quite different. Some define sources of international law by means of "sources of law", confusing the distinction between sources of domestic law and sources of international law; some present a concise concept of sources of international law, but they deny themselves; others define sources of international law by classification, On the contrary, the definition of sources of international law is in contradiction. The definition of sources of international law has formed a great theoretical misunderstanding in the field of international law. Therefore, the scientific definition of sources of international law is of great practical significance to the theory and practice of international law. The source of international law refers to the determination of the practical existence of the principles and rules of international law and the manifestations of their legal effects, which are treaties, international customs and general legal principles. This concept reveals the essential characteristics of the sources of international law and realizes the unity of the connotation and extension of the sources of international law. In the practice of international law, three different forms of sources of international law, namely, treaties, international custom and general principles of law, are used to confirm the existence and validity of norms of international law.
