【摘要】：《跨太平洋伙伴關(guān)系協(xié)定》從閉門談判,到舉世矚目,再到無人問津,經(jīng)歷了大起大落的過程。本文對《跨太平洋伙伴關(guān)系協(xié)定》談判的背景進(jìn)行了回顧,隨后對《跨太平洋伙伴關(guān)系協(xié)定》文本進(jìn)行了系統(tǒng)介紹,特別是從宗旨、貨物貿(mào)易、服務(wù)貿(mào)易、知識(shí)產(chǎn)權(quán)、投資和綜合規(guī)則等方面以及從與WTO規(guī)則對照的角度進(jìn)行了研究,展現(xiàn)了《跨太平洋伙伴關(guān)系協(xié)定》"先進(jìn)性"和"代表性"的特征。本文認(rèn)為,作為新一代貿(mào)易與投資融合的規(guī)則,《跨太平洋伙伴關(guān)系協(xié)定》文本必將成為未來多邊規(guī)則的范本�！犊缣窖蠡锇殛P(guān)系協(xié)定》文本不僅為未來多邊貿(mào)易和投資規(guī)則指明了發(fā)展方向,為所有參與談判的人員提供了文本便利,而且能夠成為測試各國談判意圖的工具,因此《跨太平洋伙伴關(guān)系協(xié)定》文本研究,包括對《跨太平洋伙伴關(guān)系協(xié)定》文本宗旨和條款的細(xì)致研讀,應(yīng)該得到重視和加強(qiáng)。
[Abstract]:The Trans-Pacific Partnership Agreement has undergone a process of ups and downs from closed-door negotiations to world-wide attention and then to lack of attention. This paper reviews the context of the negotiations on the Trans-Pacific Partnership Agreement, followed by a systematic introduction of the text of the Trans-Pacific Partnership Agreement, particularly in terms of purpose, trade in goods, trade in services, intellectual property rights, The investment and synthesis rules, as well as the comparison with WTO rules, show the characteristics of "advanced nature" and "representativeness" of "Trans-Pacific Partnership Agreement". This paper holds that, As a new generation of trade and investment integration rules, the text of the Trans-Pacific Partnership Agreement will become a model for future multilateral rules. The text of the Trans-Pacific Partnership Agreement will not only serve as the future multilateral trade and investment rules. Pointed out the direction of development, Having facilitated the text of all those involved in the negotiations and being able to serve as a tool for testing the negotiating intentions of States, the Trans-Pacific Partnership Agreement text study, Careful reading of the aims and provisions of the Trans-Pacific Partnership Agreement should be emphasized and strengthened.
