【摘要】：隨著《聯(lián)合國(guó)海洋法公約》的生效，我國(guó)具有管轄權(quán)的海域和海洋利益不斷擴(kuò)展，一些新的概念相繼被提出，海洋國(guó)土或者藍(lán)色國(guó)土就是其中之一。海洋國(guó)土概念形成的原因是多方面的，既有國(guó)際海洋法的推進(jìn)，也有國(guó)內(nèi)海洋意識(shí)的覺(jué)醒，同時(shí)也離不開現(xiàn)實(shí)海洋形勢(shì)的催促。海洋國(guó)土的觀念從萌芽到提出，后經(jīng)發(fā)展，又到現(xiàn)代的反思與總結(jié)，這既是人們對(duì)海洋認(rèn)識(shí)的深化，也是海洋開發(fā)實(shí)踐不斷發(fā)展的結(jié)果。 從國(guó)際法的視角看海洋國(guó)土的內(nèi)涵，首先要正確的區(qū)分開領(lǐng)土與國(guó)土的關(guān)系，繼而界定出國(guó)土的應(yīng)有的含義。國(guó)土實(shí)際上是一種供國(guó)家發(fā)展的空間或者資源。海洋國(guó)土作為國(guó)土的下位概念或者構(gòu)成部分，是指根據(jù)國(guó)際法或者國(guó)內(nèi)法確定，由鄰海因素產(chǎn)生的，沿海國(guó)具有非完全主權(quán)性或?qū)倥潘詸?quán)利的海洋資源及其存在的海洋空間，海洋國(guó)土的實(shí)質(zhì)是一種海洋資源或者海洋空間。 一個(gè)完整的概念是內(nèi)涵和外延的統(tǒng)一整體，海洋國(guó)土概念的外延就是要系統(tǒng)地探討各個(gè)水域與海洋國(guó)土的關(guān)系，即論證各個(gè)水域是不是屬于海洋國(guó)土的外延。對(duì)于海洋國(guó)土的外延，目前主要由最廣外延說(shuō)、中等外延說(shuō)和狹窄外延說(shuō)等不同的觀點(diǎn)。對(duì)于領(lǐng)海和專屬經(jīng)濟(jì)區(qū)爭(zhēng)議較少，都主張納入我國(guó)的海洋國(guó)土的范圍內(nèi)。內(nèi)海是內(nèi)水的一部分，但是由于其并不是國(guó)際法意義上的海洋，因此也就不能算是我們的海洋國(guó)土；對(duì)于毗連區(qū)和專屬經(jīng)濟(jì)區(qū)，毗連區(qū)單獨(dú)并不能構(gòu)成一國(guó)的海洋國(guó)土，這主要是由其法律地位和性質(zhì)決定的，但是這部分海域可基于專屬經(jīng)濟(jì)區(qū)的重合原因取得海洋國(guó)土的地位；國(guó)際海底區(qū)域是人類共同繼承的財(cái)產(chǎn)，不是任何國(guó)家專屬，，因此不能算是海洋國(guó)土，而對(duì)于國(guó)際海底區(qū)域的礦區(qū)，主要由于其取得方式和區(qū)域的法律地位原因而不能成為海洋國(guó)土。 合理界定海洋國(guó)土的概念，樹立恰當(dāng)?shù)暮Ｑ髧?guó)土觀念，才能更好地維護(hù)我們的海洋權(quán)益，實(shí)現(xiàn)我國(guó)的海洋強(qiáng)國(guó)夢(mèng)想。
[Abstract]:With the entry into force of the United Nations Convention on the law of the sea, the sea and ocean interests of our country have been expanded, and some new concepts have been put forward. The marine land or the blue land is one of them. The reasons for the formation of the concept of marine land are manifold, both the international ocean law and the awakening of the domestic ocean consciousness. At the same time, it is inseparable from the urge of the reality of the ocean. The concept of marine land is from germination to proposal, after development, and to modern reflection and summary, which is not only the deepening of people's understanding of the ocean, but also the result of the continuous development of marine development practice.
From the perspective of international law, the connotation of the marine land is first to be correctly defined as the relationship between the territory and the territory, and then the meaning of the land is defined. In fact, the land is a space or resource for the development of the country. As the lower concept or component of the land, the marine land is defined as the international law or the domestic law. The coastal state has the marine resources which are not fully sovereign or exclusive of its exclusive rights and their existing marine space. The essence of the marine land is a kind of marine resources or ocean space.
A complete concept is the unity of connotation and extension. The extension of the concept of marine land is to systematically explore the relationship between the various waters and the marine land, that is to demonstrate whether each water area belongs to the extension of the marine land. As for the territorial sea and the exclusive economic zone, there are few disputes over the territorial waters of our country. The inner sea is part of the internal water, but because it is not an ocean in the sense of international law, it can not be regarded as our marine territory; for the adjacent area and the exclusive Economic Zone, the adjacent area can not be constituted alone. The marine territory of a country is mainly determined by its legal status and nature, but this part of the sea area can be based on the coincidence of the exclusive economic zone. The international seabed region is a common inheritance of human property, not any state exclusive, so it can not be considered as a Marine Territory, and for the mine of the international seabed area. The area is not a marine territory because of the way of obtaining and the legal status of the region.
It is better to safeguard our maritime rights and interests and realize the dream of China's maritime power by reasonably defining the concept of Marine Territory and setting up an appropriate concept of Marine Territory.
