【摘要】：近年來,主權(quán)財(cái)富基金發(fā)展迅速,成為國際金融和投資領(lǐng)域重要參與者,在國際立法層面,主權(quán)財(cái)富基金的國際統(tǒng)一立法處于起步階段,大部分立法努力尚未形成正式的法律文件。對(duì)我國而言,關(guān)注這些立法活動(dòng)的動(dòng)態(tài),并努力適應(yīng)這些法律趨勢,對(duì)完善我國主權(quán)財(cái)富基金的法律規(guī)制無疑具有十分重要的意義。 鑒于此,本文對(duì)主權(quán)財(cái)富基金法律制度進(jìn)行論及,全文除了緒論與結(jié)論外,主體內(nèi)容共分為四大部分： 首先,概括介紹主權(quán)財(cái)富基金的基本理論,包括主權(quán)財(cái)富基金的內(nèi)涵、主權(quán)財(cái)富基金的歷史發(fā)展、特征并將主權(quán)財(cái)富基金同基金、外匯儲(chǔ)備等相近概念進(jìn)行了對(duì)比以便更準(zhǔn)確的了解主權(quán)財(cái)富基金這一制度。 其次,主要分析了國際社會(huì)包括國際組織和西方發(fā)達(dá)國家對(duì)主權(quán)財(cái)富基金進(jìn)行法律規(guī)制的具體立法實(shí)踐。 再次,總結(jié)我國主權(quán)財(cái)富基金的興起背景及發(fā)展現(xiàn)狀,,探析我國在主權(quán)財(cái)富基金法律規(guī)制方面存在的不足。 最后,根據(jù)全文針對(duì)我國在主權(quán)財(cái)富基金法律規(guī)制方面存在的不足,總結(jié)國際社會(huì)和發(fā)達(dá)國家經(jīng)驗(yàn),提出爭取主權(quán)財(cái)富基金法律規(guī)制的國際立法主導(dǎo)權(quán)、建立主權(quán)財(cái)富基金國家安全審查制度、完善我國主權(quán)財(cái)富基金法律風(fēng)險(xiǎn)評(píng)估體系等完善主權(quán)財(cái)富基金法律規(guī)制的建議。
[Abstract]:In recent years, sovereign wealth funds have developed rapidly and become important participants in the field of international finance and investment. At the level of international legislation, the international uniform legislation of sovereign wealth funds is in its infancy. Most legislative efforts have not yet been formalized. For our country, it is of great significance to pay attention to the development of these legislative activities and to adapt to these legal trends, which is undoubtedly of great significance to the perfection of the legal regulation of sovereign wealth funds in our country. In view of this, this paper deals with the legal system of sovereign wealth funds. In addition to the introduction and conclusion, the main content is divided into four parts: First of all, it introduces the basic theories of SWFs, including the connotation of SWFs, the historical development of SWFs, the characteristics of SWFs and the relationship between SWFs and SWFs. Similar concepts, such as foreign exchange reserves, are contrasted to better understand the sovereign wealth fund system. Secondly, it mainly analyzes the specific legislative practice of the international community, including international organizations and western developed countries, to regulate sovereign wealth funds. Thirdly, this paper summarizes the background of the rise and development of sovereign wealth funds in China, and probes into the deficiencies in the legal regulation of sovereign wealth funds in China. Finally, according to the deficiencies in the legal regulation of sovereign wealth funds in China, this paper summarizes the experiences of the international community and developed countries, and proposes to strive for the leading power of international legislation on the legal regulation of sovereign wealth funds. The suggestion of perfecting the legal regulation of sovereign wealth fund is to establish the national security review system of the sovereign wealth fund and perfect the legal risk assessment system of the sovereign wealth fund in our country.
