【摘要】:近年來(lái),海盜頻頻出現(xiàn)在新聞報(bào)道和世界各國(guó)的視野中。日益猖獗的海盜活動(dòng)無(wú)疑使本來(lái)就處于低迷的國(guó)際運(yùn)輸業(yè)雪上加霜。目前海盜對(duì)劫掠船舶、搶奪貨物的傳統(tǒng)做法不再熱衷,轉(zhuǎn)而對(duì)扣押船舶、貨物以及船員并索取贖金情有獨(dú)鐘。動(dòng)輒成百上千萬(wàn)的海盜贖金,對(duì)船貨雙方及保險(xiǎn)人來(lái)說(shuō),都是非常沉重的負(fù)擔(dān),由此也引起了一系列關(guān)于海盜贖金的糾紛,對(duì)此目前國(guó)際上沒(méi)有統(tǒng)一的規(guī)定。海盜贖金問(wèn)題因此也成為令學(xué)術(shù)界與保險(xiǎn)業(yè)都感到棘手的問(wèn)題。那么在理論上如何認(rèn)識(shí)海盜贖金?在實(shí)踐上如何操作贖金的承保賠付?處理涉及海盜贖金問(wèn)題時(shí)如何對(duì)相關(guān)當(dāng)事人進(jìn)行權(quán)利義務(wù)的配置?這些將是本文探討的內(nèi)容和核心。 本文的正文共分為五章。第一章闡述了本文的研究目的與意義、內(nèi)容與方法以及創(chuàng)新之處。第二章對(duì)海盜贖金進(jìn)行基本概述。首先介紹海盜行為與海盜贖金的關(guān)系,引入海盜行為的定義,比較分析海盜行為造成的損失類(lèi)型,得出贖金損失的特點(diǎn)。接著從海商法的基本理論入手,對(duì)海盜贖金的定義、合法性爭(zhēng)議和法律性質(zhì)進(jìn)行探討,認(rèn)為將海盜贖金作為共同海損比較合理;第三章,對(duì)海盜風(fēng)險(xiǎn)的保險(xiǎn)賠付進(jìn)行研究。首先介紹海盜贖金與海盜風(fēng)險(xiǎn)的關(guān)系,論證海盜贖金損失屬于海盜風(fēng)險(xiǎn),進(jìn)而分析現(xiàn)有的國(guó)內(nèi)外關(guān)于承保海盜風(fēng)險(xiǎn)的法律規(guī)定;第四章通過(guò)比較論證的方法,比較國(guó)際上承保海盜贖金的現(xiàn)有做法,討論我國(guó)關(guān)于海盜贖金損失支付存在的現(xiàn)狀與困難,借鑒國(guó)際慣例,得出我國(guó)應(yīng)將海盜贖金列入保險(xiǎn)賠付范圍的結(jié)論;第五章運(yùn)用保險(xiǎn)法理論,對(duì)我國(guó)海上保險(xiǎn)立法及實(shí)踐提出建議。
[Abstract]:In recent years, pirates have frequently appeared in news reports and in the vision of countries all over the world. Rampant piracy will undoubtedly add to the already depressed international transport industry. Pirates are no longer keen on hijacking ships and seizing goods, but rather have an interest in seizing ships, cargo and crew and demanding ransom. Millions of pirate ransoms are a very heavy burden on both parties and insurers, which has caused a series of disputes about pirate ransom, and there is no unified international regulation on this at present. The issue of piracy ransom has therefore become a thorny issue for both academia and the insurance industry. So, in theory, how do you know pirate ransom? How to operate the underwriting payment of ransom in practice? How do the rights and obligations of the parties concerned be allocated when dealing with the issue of piracy ransoms? These will be the content and core of this article. The text of this paper is divided into five chapters. The first chapter describes the purpose and significance of this paper, content and methods as well as innovation. The second chapter gives a basic overview of pirate ransom. Firstly, the relationship between piracy and ransom is introduced, the definition of piracy is introduced, the types of loss caused by piracy are compared and analyzed, and the characteristics of ransom loss are obtained. Then starting with the basic theory of maritime law, the definition, legitimacy dispute and legal nature of pirate ransom are discussed, and it is considered that it is more reasonable to regard pirate ransom as general average; chapter three, the study on the insurance payment of piracy risk. Firstly, it introduces the relationship between pirate ransom and piracy risk, proves that pirate ransom loss belongs to piracy risk, and then analyzes the existing domestic and foreign legal provisions on underwriting piracy risk. This paper compares the existing international practice of underwriting pirate ransom, discusses the present situation and difficulties of payment of pirate ransom loss in our country, and draws the conclusion that the pirate ransom should be included in the scope of insurance indemnity in our country by drawing lessons from international practice. Chapter five puts forward some suggestions on the legislation and practice of marine insurance in China by using the theory of insurance law.
