《聯(lián)合國反腐敗公約》視域下私營部門利益沖突問題研究

【摘要】:涵蓋公共領(lǐng)域和私營部門的利益沖突是反腐敗理論和實(shí)踐中的一項(xiàng)重要內(nèi)容。“實(shí)際上,用于打擊腐敗的立法包括幾方面的法律……調(diào)整利益沖突、保護(hù)舉報(bào)者和投訴者、控制收受禮物和款待宴請(qǐng)、禁止那些因道德行為方面而犯罪的人把持或競選公職并禁止他們獲得官職……”利益沖突在反腐敗中的基礎(chǔ)性作用和重要意義已經(jīng)在國際社會(huì)形成共識(shí),《公約》倡導(dǎo)各締約國重視利益沖突就是最好反映。利益沖突涉及公、私兩個(gè)層面,本論文把私的層面即私營部門作為研究對(duì)象。透視《公約》私營部門利益沖突的形成背景,歐美等發(fā)達(dá)區(qū)域的國際組織、國家和地區(qū)較為完善,而亞非等發(fā)展中區(qū)域的國際組織、國家和地區(qū)還欠成熟。我國雖有散見于黨紀(jì)國法中的類似利益沖突制度規(guī)定,但其大都指向公的層面,私的層面沒有受到重視,只是個(gè)別經(jīng)濟(jì)法律法規(guī)中存在一些類似利益沖突性質(zhì)的制度規(guī)范,且并非是在利益沖突科學(xué)理念指導(dǎo)下完成的,而是“一事一議”的補(bǔ)救式做法。應(yīng)當(dāng)說,直至2009年9月,我國明確提出“建立健全防止利益沖突制度”前,該制度始終尚付闕如。本文正是在這樣一種國際和國內(nèi)背景下,通過對(duì)《公約》私營部門利益沖突內(nèi)涵及相關(guān)要素研究,對(duì)比主要國際組織、國家和地區(qū)私營部門利益沖突制度建設(shè)做法,考察我國私營部門利益沖突制度建設(shè)現(xiàn)狀,在此基礎(chǔ)上,對(duì)我國私營部門利益沖突制度建設(shè)進(jìn)行了深入思考,并提出了建議和理由。 論文由引言、正文和結(jié)論等8部分構(gòu)成。 第1章“引言”。主要對(duì)論文選題背景、選題意義、研究現(xiàn)狀以及研究方法等進(jìn)行了闡述,意在說明論文具有一定挑戰(zhàn)性和創(chuàng)新性。 第2章“《公約》利益沖突內(nèi)涵及相關(guān)性”。主要對(duì)《公約》視野下的利益沖突內(nèi)涵、特征、遵循原則、立法形式、價(jià)值目標(biāo)和理論基礎(chǔ)等進(jìn)行了研究,特別是對(duì)新形勢(shì)下的利益沖突內(nèi)涵提出了筆者自己的新見解。 第3章“《公約》私營部門利益沖突起源”。在利益沖突制度的整個(gè)歷史發(fā)展過程中探尋私營部門利益沖突的起源,認(rèn)為美國“水門事件”和日本“洛克希德商業(yè)賄賂案”標(biāo)志著私營部門利益沖突制度的正式形成。 第4章“《公約》私營部門利益沖突形態(tài)”。私營部門利益沖突形態(tài)是不能回避的一個(gè)重要問題,它直接關(guān)系對(duì)利益沖突的范疇界定以及規(guī)制措施。筆者從利益沖突實(shí)施手段、危害后果和參與主體等3個(gè)層面對(duì)私營部門利益沖突形態(tài)進(jìn)行深入解剖,旨在說明私營部門利益沖突存在形態(tài)的多樣性和復(fù)雜性。 第5章“《公約》私營部門利益沖突控制措施”。《公約》對(duì)私營部門利益沖突問題予以關(guān)注開闊了利益沖突制度研究新視野。論文從私營部門與利益沖突內(nèi)在聯(lián)系以及控制措施等方面對(duì)《公約》私營部門利益沖突規(guī)范予以論證,同時(shí)對(duì)主要國際組織、國家和地區(qū)實(shí)踐進(jìn)行了考察。 第6章“我國私營部門利益沖突現(xiàn)狀”。為全面了解和清醒認(rèn)識(shí)我國私營部門利益沖突建設(shè)情況,更好地與對(duì)《公約》私營部門利益沖突制度的研究成果對(duì)接并進(jìn)行轉(zhuǎn)化,論文從理論、實(shí)踐和制度建設(shè)三個(gè)層面總結(jié)和分析了我國私營部門利益沖突發(fā)展現(xiàn)狀。 第7章“我國私營部門利益沖突制度建設(shè)思考”。從私營部門反腐敗重大意義、國際公約轉(zhuǎn)化為國內(nèi)法、私營部門納入我國“懲防”體系、制定覆蓋公私領(lǐng)域的《反腐敗法》、突出《反腐敗法》的域外效力和完善私營部門利益沖突控制措施等6個(gè)方面進(jìn)行了思考,提出了建議并闡述了理由。 第8章“結(jié)論”。私營部門利益沖突制度與公共領(lǐng)域和公職人員利益沖突制度一樣,具有其它反腐敗制度不能替代的治本性功能,在“懲防”體系特別是“防”的體系中至關(guān)重要。在《公約》倡導(dǎo)下,在國際社會(huì)各方努力下,私營部門利益沖突會(huì)得到包括我國在內(nèi)的更多國家和地區(qū)重視。
[Abstract]:The conflict of interest in anti - corruption lies in the public , private and private sectors .


The thesis consists of 8 parts , such as introduction , text and conclusion .


Chapter 1 introduces the background , the significance , the research situation and the research methods of the thesis . It is intended to illustrate the challenges and creativity of the thesis .


Chapter 2 focuses on the connotation , characteristics , compliance , legislative form , value objective and theoretical basis of conflicts of interest in the perspective of the Convention , especially the connotation of conflict of interest in the new situation .


Chapter 3 " Origin of conflict of interest in private sector " . In the course of the whole historical development of the conflict of interest , the origin of the private - sector conflict of interest is explored , and it is believed that the " Watergate Event " and the " Case of Commercial Bribery in the West " of Japan mark the formal formation of the private - sector conflict of interest .


Chapter 4 " Conflict of Interest Conflict in Private Sector " . Private - sector conflict of interest is an important issue that cannot be avoided . It is directly related to the definition of the category of conflict of interest and the regulation measures . The author deeply dissected the pattern of conflict of interest in the private sector from three aspects , such as the means of conflict of interest , the consequence of the harm and the participation subject , and it is intended to illustrate the diversity and complexity of the existence form of the conflict of interest in the private sector .


Chapter 5 discusses the conflict of interest conflict between private sector and private sector . The paper discusses the conflict of interest conflict between the private sector and interest conflict and the control measures , and also makes a study on the practice of major international organizations , countries and regions .


Chapter 6 " The present situation of private - sector conflict of interest in China " . From the great significance of the private sector , the international conventions have been translated into domestic law , the private sector is incorporated into China ' s " punishment prevention " system , and six aspects , such as the anti - corruption laws in the public - private field , the extraterritorial effect of the anti - corruption law , and the control measures of the private sector ' s conflict of interest , are put forward . The suggestions are put forward and the reasons are set forth .


Chapter 8 " Conclusion " . The private - sector conflict of interest system , like the system of conflict of interest between public and public officials , is of vital importance in a system with other anti - corruption systems that cannot be replaced by other anti - corruption systems . Under the aegis of the UNCCD , private - sector conflict of interest will receive greater attention from more countries and regions , including our country , with the efforts of the international community .
