【摘要】：大湄公河次區(qū)域的環(huán)境合作對(duì)于該地區(qū)的經(jīng)濟(jì)和發(fā)展至關(guān)重要�，F(xiàn)在,該地區(qū)的環(huán)境合作是以項(xiàng)目為基礎(chǔ)的,缺乏制度保障,已經(jīng)發(fā)生的和潛在的糾紛沒有得到妥善的解決。該地區(qū)的六國之間尚未就環(huán)境合作的基本規(guī)則達(dá)成共識(shí),也沒有六國共同支持的環(huán)境合作機(jī)構(gòu)和適宜該地區(qū)的爭端解決機(jī)制。雖然國際河流的條約規(guī)則和習(xí)慣規(guī)則發(fā)展得都很緩慢,但都是向著強(qiáng)調(diào)流域內(nèi)的公平和限制自由利用的方向發(fā)展的,這樣的發(fā)展方向?qū)τ谏嫌螄也⒉焕�。所�?處于瀾滄江—湄公河上游的中國,應(yīng)該著手與中下游國家建立環(huán)境合作的法律機(jī)制,共同商討該地區(qū)的經(jīng)濟(jì)開發(fā)對(duì)環(huán)境可能產(chǎn)生的影響問題,充分發(fā)揮區(qū)域內(nèi)的大國在穩(wěn)定該地區(qū)的經(jīng)濟(jì)發(fā)展和保障沿岸國的長久利益方面的引領(lǐng)作用。
[Abstract]:Environmental cooperation in the Greater Mekong Subregion is vital to the region's economy and development. At present, environmental cooperation in the region is project-based, lacking institutional safeguards, and existing and potential disputes are not properly resolved. The six countries in the region have not reached a consensus on the basic rules of environmental cooperation, nor has there been a body for environmental cooperation supported by the six countries and a dispute settlement mechanism suitable for the region. Although the treaty rules and customary rules of international rivers have developed very slowly, they have developed towards the direction of emphasizing equity and restricting free use in the river basin, which is not beneficial to the upstream countries. Therefore, China, located in the upper reaches of the Lancang-Mekong River, should begin to establish a legal mechanism for environmental cooperation with countries in the middle and lower reaches to jointly discuss the possible impact of economic development in the region on the environment. Give full play to the leading role of the major powers in the region in stabilizing the region's economic development and safeguarding the long-term interests of the coastal countries.
