【摘要】：WTO上訴機(jī)構(gòu)作為WTO爭(zhēng)端解決機(jī)構(gòu)中的常設(shè)機(jī)構(gòu),在世界經(jīng)濟(jì)環(huán)境瞬息萬(wàn)變的今天,對(duì)國(guó)際貿(mào)易爭(zhēng)端的有效緩解和解決起到了至關(guān)重要的作用,然而,其所面臨的挑戰(zhàn)也在不斷顯現(xiàn)。其中,爭(zhēng)端解決程序的效率拖延問(wèn)題已經(jīng)成為各成員方討論的焦點(diǎn),程序的拖延使WTO成員方開(kāi)始尋求其他程序解決爭(zhēng)端,很大程度上影響了WTO爭(zhēng)端解決機(jī)制的可靠性和有效性。本文結(jié)合WTO上訴爭(zhēng)端解決效率拖延的典型案例,剖析了其中的原因,指出了需要重視的幾個(gè)問(wèn)題。
[Abstract]:As a permanent body in the WTO dispute settlement body, the WTO Appellate body plays a vital role in the effective mitigation and settlement of international trade disputes in the rapidly changing world economic environment. The challenges it faces are also emerging. Among them, the efficiency procrastination of the dispute settlement procedure has become the focus of discussion among the members. The delay of the procedure makes the WTO members start to seek other procedures to resolve the dispute, which greatly affects the reliability and effectiveness of the WTO dispute settlement mechanism. Based on the typical case of WTO dispute settlement efficiency delay, this paper analyzes the reasons and points out some problems that need to be paid attention to.
