【摘要】：國際空間法體系主要規(guī)范空間碎片減緩措施,對能夠切實減少碎片數(shù)量的碎片主動移除措施尚未形成統(tǒng)一規(guī)定。由于空間碎片的法律概念和所有權(quán)、管轄權(quán)的規(guī)定尚存立法空白,天基空間碎片主動移除可能被視為空間軍事活動,進而引發(fā)外空軍事化的爭議以及違反和平利用外層空間原則及禁止使用武力原則的合法性爭議。厘清天基碎片主動移除的非軍事化界限有助于國際社會統(tǒng)一主動移除的法律定性。對現(xiàn)行的國際空間條約的分析表明,空間碎片具有"潛在有害干擾"的法律特征,會對正常空間活動造成負面影響。因此主動移除碎片應遵循"消除空間碎片對空間活動的危害"的基本準則,據(jù)此進行的碎片移除不應屬于外空軍事化或非法使用武力的范疇。
[Abstract]:The system of international space law mainly regulates space debris mitigation measures, and there is no uniform regulation on active debris removal measures which can effectively reduce the amount of debris. Owing to the legal concept and ownership of space debris and the remaining legislative gaps in the provision of jurisdiction, the active removal of space-derived space debris may be considered a space military activity, Thus, the militarization of outer space and the legality of violating the principle of peaceful use of outer space and the prohibition of the use of force. Clarifying the demilitarized boundary of active removal of space-based debris helps the international community to unify the legal characterization of active removal. An analysis of existing international space treaties shows that space debris has a legal character of "potentially harmful interference" and can have a negative impact on normal space activities. The active removal of debris should therefore follow the basic guidelines of "eliminating the harm of space debris to space activities", according to which debris removal should not fall within the scope of the militarization of outer space or the illegal use of force.
