【摘要】：恐怖主義是指任何組織或個人為了制造社會恐慌,破壞國家穩(wěn)定、社會發(fā)展的長治久安,危害國家安全和公共安全,侵犯人身財產(chǎn)安全,或者脅迫國家機(jī)關(guān)、政府組織等,以期實(shí)現(xiàn)其政治主張、意識形態(tài)思潮而采取的暴力、破壞、恐嚇等手段,肆意對公眾目標(biāo)或任何部位實(shí)施危害行為的嚴(yán)重暴力犯罪活動。對恐怖活動組織和人員的認(rèn)定必須準(zhǔn)確把握當(dāng)前國內(nèi)外反恐怖斗爭形勢,防止國際社會的“極左”“極右”兩個社會思潮在我國出現(xiàn),借鑒國外的立法經(jīng)驗(yàn),堅持程序法定、以事實(shí)為依據(jù)以法律為準(zhǔn)繩的兩大認(rèn)定原則,以法律術(shù)語嚴(yán)謹(jǐn)性、法益侵害性、刑法謙抑性、罪責(zé)刑相適應(yīng)原則為指導(dǎo),提出我國對恐怖活動組織、恐怖活動重點(diǎn)人員、恐怖活動異常跡象人員和宗教極端人員之認(rèn)定標(biāo)準(zhǔn)的立法建議,為進(jìn)一步懲治恐怖主義犯罪提供完善的法律保障。
[Abstract]:Terrorism refers to any organization or individual who, in order to create a social panic, destroys state stability, the long-term stability of the social development, endangers state security and public safety, infringes on the safety of personal property, or coercion state organs and government organizations, in order to achieve its political claims and ideological trends, such as violence, destruction, and intimidation. It is necessary to accurately grasp the current situation of anti terrorist struggle at home and abroad and prevent the two social thoughts of "extreme left" and "extreme right" of the international community to come out in our country, draw lessons from foreign legislative experience and adhere to procedural law. On the basis of the two major principles on the basis of the law and the principle of law based on the facts, the legislative proposals on the standards of the organization of terrorist activities, the key personnel of terrorist activities, the personnel of terrorist activities and the extremes of religious extremes are put forward by the principles of the rigor of legal terms, the infringement of legal interests, the humility of the criminal law and the principle of adaptation to the criminal responsibility and punishment. We should further improve the legal protection of terrorist crimes.
