【摘要】：在金融全球化的背景下,金融危機(jī)具有了普遍性與傳導(dǎo)性,2007年美國金融危機(jī)的發(fā)生和蔓延再次引起了國際社會(huì)對(duì)金融監(jiān)管的高度重視,國際社會(huì)普遍認(rèn)為應(yīng)加強(qiáng)在金融監(jiān)管領(lǐng)域的法律合作與協(xié)調(diào),為各國和地區(qū)的金融市場穩(wěn)定創(chuàng)造條件,金融監(jiān)管國際法律合作已經(jīng)成為金融市場、金融活動(dòng)國際化的必然。因此,創(chuàng)建國際金融監(jiān)管新秩序,構(gòu)建一個(gè)統(tǒng)一的金融監(jiān)管法律體系是未來國際金融發(fā)展的必然趨勢。通過對(duì)現(xiàn)存文獻(xiàn)的比較分析,可以看到金融危機(jī)之后,各國都在積極推進(jìn)金融監(jiān)管改革并進(jìn)一步謀求國際金融監(jiān)管法律合作,截至目前,在國際金融領(lǐng)域已經(jīng)形成了多個(gè)區(qū)域性或多邊合作組織,并通過了相關(guān)的法律文件。金融監(jiān)管國際合作法律實(shí)踐已經(jīng)證明,金融監(jiān)管國際法律合作不僅必要而且具有可行性,現(xiàn)已形成的國際性合作形式業(yè)已為建立統(tǒng)一的金融監(jiān)管國際合作法律機(jī)制奠定了基礎(chǔ)�；诮鹑诒O(jiān)管活動(dòng)的特殊性,國際社會(huì)至今尚未形成國際金融監(jiān)管合作的統(tǒng)一法律體系,而金融活動(dòng)全球化對(duì)于國際金融監(jiān)管合作的緊迫要求使得健全金融監(jiān)管國際合作法律框架成為現(xiàn)今國際社會(huì)探討的重要課題之一。金融監(jiān)管國際合作的法律框架應(yīng)在加強(qiáng)國際金融活動(dòng)監(jiān)管的前提下進(jìn)行構(gòu)建,國際金融監(jiān)管主體的范圍應(yīng)由各個(gè)國家和地區(qū)的監(jiān)管當(dāng)局?jǐn)U展至全球性或區(qū)域性的國際金融組織,通過為各國監(jiān)管部門提供國際金融監(jiān)管法律合作的平臺(tái)和機(jī)制,以及制定相關(guān)的行業(yè)監(jiān)管標(biāo)準(zhǔn)等完成國際法律合作的目標(biāo);國際金融監(jiān)管的合作形式則可以通過制定金融監(jiān)管多邊國際條約和形成統(tǒng)一的國際金融監(jiān)管規(guī)則實(shí)現(xiàn);國際金融監(jiān)管的合作結(jié)構(gòu)則可體現(xiàn)為多重靈活的雙邊金融監(jiān)管法律合作、區(qū)域范圍內(nèi)的金融監(jiān)管法律合作及全球?qū)用娴慕鹑诒O(jiān)管國際法律合作,最終實(shí)現(xiàn)對(duì)國際金融活動(dòng)合作監(jiān)管的宗旨。
[Abstract]:Under the background of financial globalization, the financial crisis has universality and conductivity. In 2007, the occurrence and spread of the financial crisis in the United States has caused the international community to attach great importance to financial supervision. The international community generally believes that the legal cooperation and coordination in the field of financial supervision and regulation should be strengthened to create a stable financial market for various countries and regions. The international legal cooperation of financial supervision has become a financial market, and the internationalization of financial activities is inevitable. Therefore, to create a new order of international financial supervision and to build a unified legal system of financial supervision is the inevitable trend of the future international financial development. At present, many regional or multilateral cooperative organizations have been formed in the international financial field and relevant legal documents have been formed in the international financial field. The legal practice of international cooperation in financial supervision has proved that international legal cooperation in financial supervision is not only necessary but also necessary. The form of international cooperation, which has been formed, has laid the foundation for the establishment of a unified legal mechanism for international cooperation in financial supervision and regulation. Based on the particularity of the financial regulatory activities, the international community has not yet formed a unified legal system for international financial supervision and cooperation, and the globalization of gold and financial activities for international financial supervision and cooperation. The legal framework for international cooperation in financial supervision has become one of the most important issues in the international community. The legal framework for international financial supervision and supervision should be built on the premise of strengthening the supervision of international financial activities. The scope of the subject of international financial supervision should be extended to all countries and regions. Spherical or regional international financial organizations, through the provision of the platform and mechanism for international financial supervision and legal cooperation for the regulatory departments of various countries, and the establishment of relevant regulatory standards for the industry to complete international legal cooperation; the form of cooperation in international financial supervision can be made through the formulation of multilateral international treaties on financial supervision and the formation of unity. The international financial supervision rules can be realized, and the cooperation structure of international financial supervision can be embodied in the multi flexible bilateral financial supervision and legal cooperation, the regional financial supervision and legal cooperation and international legal cooperation on financial supervision at the global level, and the ultimate realization of the aim of the supervision of international financial cooperation and cooperation.
