【摘要】:歐盟是對(duì)華反傾銷最厲害的地區(qū),世界上第一例對(duì)華反傾銷案件就是1979年歐盟發(fā)起的對(duì)我國(guó)出口的糖精鈉進(jìn)行的反傾銷調(diào)查。在此后的三十多年里,歐盟是我國(guó)最主要的貿(mào)易伙伴之一,同時(shí)也是對(duì)我國(guó)產(chǎn)品發(fā)起反傾銷調(diào)查和采取反傾銷措施的數(shù)量也是最多的。最近幾年,歐盟對(duì)我國(guó)發(fā)起的反傾銷案件不斷增多,反傾銷的對(duì)象也有了擴(kuò)大的趨勢(shì):由過去主要以低附加值的輕紡、機(jī)電等產(chǎn)品作為反傾銷調(diào)查的對(duì)象,發(fā)展到現(xiàn)在高新技術(shù)產(chǎn)品也頻頻被發(fā)起反傾銷調(diào)查,這種狀況在很大程度上影響了我國(guó)出口增長(zhǎng)的穩(wěn)定性。反傾銷啟動(dòng)機(jī)制作為整個(gè)反傾銷程序中首要的環(huán)節(jié)也是最重要的環(huán)節(jié),研究歐盟反傾銷程序的啟動(dòng)方式,歐盟反傾銷啟動(dòng)程序的特點(diǎn)以及我國(guó)如何利用歐盟反傾銷啟動(dòng)機(jī)制的規(guī)定和特點(diǎn)有效避免反傾銷程序的啟動(dòng)具有十分重要的現(xiàn)實(shí)意義。 基于目前歐盟對(duì)我國(guó)頻繁發(fā)起反傾銷調(diào)查的嚴(yán)重形勢(shì),本文選取歐盟反傾銷啟動(dòng)機(jī)制的這一程序法角度,全面介紹和分析歐盟反傾銷啟動(dòng)機(jī)制的相關(guān)規(guī)定和特點(diǎn),以歐盟委員會(huì)進(jìn)行反傾銷立案必須構(gòu)成有效申訴的條件作為主突破口,找尋我國(guó)企業(yè)頻頻引致歐盟對(duì)華反傾銷程序啟動(dòng)及絕大部分被采取反傾銷措施的原因,并探討中國(guó)政府、行業(yè)協(xié)會(huì)及企業(yè)在應(yīng)對(duì)歐盟對(duì)華反傾銷程序中如何利用有效申訴的條件這一突破口,采取措施阻止歐盟相關(guān)產(chǎn)業(yè)的申訴構(gòu)成有效申訴,從而避免進(jìn)入反傾銷的實(shí)質(zhì)審查階段,并達(dá)到避免被采取反傾銷措施的后果。全文分為四章。 第一部分是導(dǎo)言,即問題的提出,從分析歐盟對(duì)華反傾銷的態(tài)勢(shì),闡述了研究歐盟反傾銷啟動(dòng)機(jī)制所具有的理論和現(xiàn)實(shí)意義。 第一章,對(duì)整個(gè)反傾銷啟動(dòng)機(jī)制進(jìn)行了介紹和探討,按照反傾銷機(jī)構(gòu)設(shè)置,反傾銷啟動(dòng)機(jī)制分為單軌制、雙軌制、準(zhǔn)雙軌制和多軌制四種形式。按照啟動(dòng)方式又可以分為兩種形式。 第二章詳細(xì)介紹和分析了歐盟反傾銷啟動(dòng)機(jī)制的規(guī)定和特點(diǎn)。應(yīng)申訴立案是歐盟最主要的反傾銷啟動(dòng)方式,而反傾銷機(jī)構(gòu)自行啟動(dòng)則是其有效補(bǔ)充方式。 第三章結(jié)合案例分析了我國(guó)企業(yè)頻頻引發(fā)歐盟反傾銷程序啟動(dòng)的原因,為第四部分提出應(yīng)對(duì)策略打下基礎(chǔ),指出經(jīng)濟(jì)結(jié)構(gòu)不合理、惡性競(jìng)爭(zhēng)、企業(yè)配合不力等問題是造成我國(guó)企業(yè)屢屢引致歐盟反傾銷調(diào)查程序啟動(dòng)和在遭受反傾銷后大部分被采取反傾銷措施的主要原因。 第四章在對(duì)反傾銷啟動(dòng)機(jī)制的規(guī)定和特點(diǎn)進(jìn)行分析的基礎(chǔ)上,結(jié)合我國(guó)企業(yè)頻頻引發(fā)歐盟反傾銷啟動(dòng)的原因,從避免反傾銷調(diào)查程序的啟動(dòng)角度談我國(guó)政府、企業(yè)和行業(yè)協(xié)會(huì)在應(yīng)對(duì)和防范歐盟對(duì)華反傾銷的對(duì)策。此部分是本文的落腳點(diǎn)。
[Abstract]:The European Union (EU) is the most serious antidumping region against China. The first anti-dumping case against China in the world is the anti-dumping investigation initiated by the EU against China's exports of saccharin sodium in 1979. In the following thirty years, the EU is one of the most important trading partners of our country, and it is also the largest number of anti-dumping investigations and antidumping measures against our products. In recent years, the European Union has initiated more and more anti-dumping cases against China, and the targets of anti-dumping have also been expanded. In the past, the EU mainly used low-value-added textile, electromechanical and other products as the object of anti-dumping investigations. The development of high and new technology products has been frequently initiated anti-dumping investigations, which greatly affected the stability of China's export growth. As the first and most important link in the whole anti-dumping proceedings, the anti-dumping initiation mechanism is also the most important link. It is of great practical significance for China to make use of the regulations and characteristics of EU anti-dumping initiation mechanism to avoid the initiation of anti-dumping procedure. Based on the serious situation that the EU frequently initiated anti-dumping investigations against China, this paper selects the procedural law angle of EU anti-dumping initiation mechanism, and comprehensively introduces and analyzes the relevant regulations and characteristics of EU anti-dumping initiation mechanism. Taking the condition that the European Commission must form an effective complaint to file an anti-dumping case as the main breakthrough point, to find out why Chinese enterprises frequently led to the initiation of the EU anti-dumping proceedings against China and most of the anti-dumping measures taken by the EU, and to probe into the Chinese government. Trade associations and enterprises in dealing with the EU anti-dumping proceedings against China how to make use of the conditions of effective complaints, take measures to prevent EU related industries from making effective complaints, thus avoiding entering the stage of substantive review of anti-dumping. And to avoid the consequences of anti-dumping measures. The full text is divided into four chapters. The first part is the introduction, that is, the question put forward, from the analysis of the situation of EU anti-dumping against China, the paper expounds the theoretical and practical significance of the study of EU anti-dumping initiation mechanism. The first chapter introduces and discusses the whole mechanism of anti-dumping initiation. According to the mechanism of anti-dumping, the mechanism can be divided into four forms: monorail system, dual-track system, quasi-dual-track system and multi-track system. According to the startup mode can be divided into two forms. The second chapter introduces and analyzes the regulations and characteristics of EU anti-dumping initiation mechanism in detail. Filing a complaint is the most important way to start anti-dumping in EU, and self-initiation of anti-dumping agency is an effective supplementary way. The third chapter analyzes the reasons why Chinese enterprises frequently start the EU anti-dumping procedure, lays the foundation for the fourth part, and points out that the economic structure is unreasonable, and the vicious competition. The lack of cooperation among enterprises is the main reason why Chinese enterprises often lead to the initiation of anti-dumping investigation procedure in EU and the antidumping measures taken by most of them after being subjected to antidumping. On the basis of the analysis of the regulations and characteristics of anti-dumping initiation mechanism, the fourth chapter discusses the Chinese government from the angle of avoiding the initiation of anti-dumping investigation procedure, combining with the reasons why Chinese enterprises frequently trigger the EU anti-dumping initiation. Enterprises and trade associations are responding to and preventing EU anti-dumping measures against China. This part is the foothold of this article.
