【摘要】：在外交和國際關系中,國家利益是最核心的概念,維護和實現(xiàn)國家利益被認為是任何國家外交的出發(fā)點和落腳點。隨著中國的改革開放和經(jīng)濟全球化的深入發(fā)展,中國的國家利益不斷向外擴展,海外利益在中國國家利益結構中的地位呈上升趨勢。在中國的海外利益中,絕大部分涉及普通公民在國外的切身利益與合法權益,維護他們的生命、財產(chǎn)安全成為中國外交工作的基本職責所在。 近年來中國公民在海外遭遇的安全問題日益復雜和嚴峻,保障海外中國公民的安全成為維護中國國家利益和中國海外利益的重要內容,是新時期中國外交面臨的一項重要研究議題。中國政府對海外中國公民安全狀況的密切關注與重視反映出中國外交政策從國家中心主義到關注公民個人權益的戰(zhàn)略轉變,體現(xiàn)了“以人為本、執(zhí)政為民”的執(zhí)政理念,與世界人本化的進步潮流相契合,是中國外交、內政與國際環(huán)境、國際體系之間良性互動的結果。 本文主要分為四個部分。第一部分,論述了國際上保護海外公民的相關理論與主要做法并對其進行評價,以為海外中國公民安全保護的相關理論和實踐提供借鑒意義。第二部分開始切入論文的寫作主題。對海外中國公民相關概念和海外中國公民安全保護的相關概念作出界定。第三部分,主要從國際關系和中國外交的角度,對晚清時期、民國、新中國至改革開放以來海外中國公民安全保護的歷史邏輯與制度變遷進行了梳理,并總結其中的經(jīng)驗、教訓。第四部分對當前中國政府的海外中國公民安全保護政策提出了對策建議,使對海外中國公民的安全保護工作更好地服從和服務于中國的總體外交戰(zhàn)略與國家發(fā)展大局。 論文第一章通過對海外利益中公民安全保護的相關理論與實踐的闡述,從國際法、國際關系、中國外交等多維視角出發(fā),結合國際體系的社會建構作用、國家定位和國際關系中的權力因素、國家利益觀念的認知變化等,最終嘗試為海外中國公民安全保護問題提供一個理論分析框架。 第二章首先從公民和中國公民的概念入手,引出對海外中國公民的界定。通過仔細區(qū)分華僑、華人等易混淆的相關概念來加深對海外中國公民這一概念的理解。其次,為了更好的突出對中國公民進行安全保護的重要性,文章一方面從國家利益的概念,國家利益的產(chǎn)生、發(fā)展和變化,國家利益的層次構成和國家利益的性質四個方面進行論述,進而引申出海外中國公民在中國海外利益中的重要地位;另一方面,通過總結海外中國公民面臨的主要安全風險來源和安全風險變化,再次突出對海外公民進行安全保護的現(xiàn)實緊迫性與必要性,并最終歸納出海外中國公民安全保護的概念。 第三四章從中國政府對海外中國公民實行安全保護政策的歷史邏輯與制度變遷方面進一步論證第二章的理論框架。主要梳理了晚清、民國、新中國至改革開放以來的海外中國公民安全保護政策,重點梳理了改革開放以后,特別是20世紀90年代至新世紀以來中國政府對海外中國公民的安全保護政策。通過描述不同時期中國政府對海外中國公民實行安全保護的時代背景與特點,總結其中的外交思想、相關機制建設中的經(jīng)驗、教訓,以為當前中國政府的海外中國公民安全保護政策提出可供參考的建議。 論文第五章論述了中國政府當前對海外中國公民安全保護的現(xiàn)狀與特點,通過總結出國內外對中國政府海外中國公民安全保護政策的評價,最終嘗試為海外中國公民的安全保護政策提供一些對策建議。
[Abstract]:With the deepening development of China ' s reform and opening - up and the globalization of the economy , China ' s national interests continue to expand outward , and the status of overseas interests in China ' s national interest structure is rising . In the overseas interests of China , most of the overseas interests involve the interests and legitimate rights and interests of ordinary citizens abroad and safeguard their lives .


In recent years , Chinese citizens have been confronted with more and more complicated security problems overseas , and the security of Chinese citizens abroad has become an important topic to safeguard China ' s national interests and the overseas interests of China .


This paper is divided into four parts . The first part discusses the relevant theories and main methods of protecting the overseas citizens internationally and evaluates them to provide reference for the relevant theories and practices of the overseas Chinese citizen safety protection . The third part is mainly based on the international relations and the Chinese diplomacy . The third part mainly discusses the overseas Chinese citizen ' s safety protection policy and puts forward some suggestions on the overseas Chinese citizen safety protection policy . The fourth part puts forward some suggestions on the current Chinese government ' s overseas Chinese citizen safety protection policy . In the first chapter , through the elaboration of the relevant theories and practices of citizen safety protection in the overseas interests , from the multi - dimensional perspectives of international law , international relations and Chinese diplomacy , the thesis tries to provide a theoretical analysis framework for the protection of overseas Chinese citizens by combining the social construction of the international system , the power factor in the national positioning and international relations , the cognitive change of the national interest concept and so on .


The second chapter begins with the concept of citizen and Chinese citizen , and draws out the definition of Chinese citizen overseas . In order to highlight the importance of Chinese citizen ' s safety protection , this article discusses on one hand the important position of overseas Chinese citizens in China ' s overseas interests . On the other hand , by summarizing the main security risk sources and security risk changes faced by overseas Chinese citizens , this article further highlights the urgency and necessity of safety protection of overseas Chinese citizens , and finally concludes the concept of overseas Chinese citizen safety protection .


The third chapter further demonstrates the theoretical framework of the second chapter from the historical logic and institutional change of the Chinese government ' s policy on the safety protection policy of Chinese citizens overseas . The policy of Chinese government ' s safety protection for Chinese citizens since the reform and opening up , especially since the 1990 ' s to the new century , is discussed .


The fifth chapter discusses the current situation and characteristics of the Chinese government ' s current protection of Chinese citizens abroad , and summarizes the evaluation of the Chinese government ' s overseas Chinese citizen safety protection policy at home and abroad , and finally tries to offer some countermeasures to the overseas Chinese citizens ' safety protection policy .
