【摘要】：《紐約公約》第5條第2款確立了公共政策制度,但是并沒有對其含義、范圍以及具體內(nèi)容作出規(guī)定和解釋。這種情形可能會妨礙對公共政策在《紐約公約》中的性質(zhì)之理解,繼而影響對《紐約公約》第5條的完整理解以及《紐約公約》中的公共政策的準(zhǔn)確適用,因而需要澄清公共政策在《紐約公約》中的性質(zhì)問題。對公共政策性質(zhì)的理解,有助于本文進(jìn)一步檢討我國有關(guān)法律規(guī)定,并對照《紐約公約》加以完善。
[Abstract]:Article 5, paragraph 2, of the New York Convention establishes the system of public policy, but does not define and interpret its meaning, scope and content.Such a situation may hamper the understanding of the nature of public policy in the New York Convention and, in turn, the complete understanding of article 5 of the New York Convention and the precise application of public policy in the New York Convention,It is therefore necessary to clarify the nature of public policy in the New York Convention.The understanding of the nature of public policy is helpful for this article to further review the relevant laws and regulations of our country and to perfect it with reference to the New York Convention.
