【摘要】：海外投資保險(xiǎn)制度是資本輸出國為了保護(hù)本國國民在國外投資的安全,對本國海外投資者在國內(nèi)實(shí)行的一種以事后彌補(bǔ)非商業(yè)風(fēng)險(xiǎn)損失為目的的保險(xiǎn)制度。美國于1948年首創(chuàng)該制度,成效顯著,之后各主要資本輸出國相繼建立了符合自身國情的海外投資保險(xiǎn)制度。近年來,我國海外投資呈現(xiàn)蓬勃發(fā)展態(tài)勢,但同時(shí)也面臨著較大的政治風(fēng)險(xiǎn)。然而,目前我國尚未建立完備的海外投資保險(xiǎn)制度,對于我國企業(yè)制定全球發(fā)展戰(zhàn)略極為不利。本文擬在比較研究的基礎(chǔ),就構(gòu)建和完善我國海外投資保險(xiǎn)制度,作初步的探討。 本文正文共分四部分,各部分主要內(nèi)容如下：第一部分海外投資保險(xiǎn)制度的概述。從海外投資保險(xiǎn)制度的概念、特征、性質(zhì)、作用和意義入手,接著介紹海外投資保險(xiǎn)制度的歷史沿革,以便對海外投資保險(xiǎn)制度有全面的認(rèn)識。第二部分主要資本輸出國海外投資保險(xiǎn)制度及MIGA的考察與比較。首先介紹了美、日、德及多邊投資擔(dān)保機(jī)構(gòu)較成熟的海外投資保險(xiǎn)制度,然后對美、日、德及多邊投資擔(dān)保機(jī)構(gòu)的立法實(shí)踐進(jìn)行比較分析,以期對我國海外投資保險(xiǎn)制度的建立和完善提供有效的借鑒。第三部分我國海外投資保險(xiǎn)制度的現(xiàn)狀及問題。主要介紹了我國海外投資保險(xiǎn)制度的現(xiàn)狀、存在的問題,并分析了建立我國海外投資保險(xiǎn)制度的必要性、可能性。第四部分我國海外投資保險(xiǎn)制度的立法構(gòu)想。本章圍繞海外投資保險(xiǎn)制度中的模式選擇、承保機(jī)構(gòu)的一元制與二元制、合格海外投資者及合格海外投資問題進(jìn)行闡述。同時(shí),在比較分析的基礎(chǔ)上,就構(gòu)建我國海外投資保險(xiǎn)制度中的相應(yīng)問題提出設(shè)計(jì)構(gòu)想。
[Abstract]:The overseas investment insurance system is a kind of insurance system adopted by the capital exporting countries in order to protect the safety of their nationals' investment abroad, which aims to make up for the loss of non-commercial risk afterwards.The United States first established this system in 1948, and the major capital exporting countries established the overseas investment insurance system according to their own conditions one after another.In recent years, our country overseas investment presents the vigorous development tendency, but also faces the bigger political risk.However, at present, China has not established a complete overseas investment insurance system, which is extremely disadvantageous for Chinese enterprises to formulate global development strategy.On the basis of comparative study, this paper makes a preliminary discussion on the construction and improvement of China's overseas investment insurance system.This paper is divided into four parts. The main contents of each part are as follows: the first part is an overview of overseas investment insurance system.This paper starts with the concept, characteristics, nature, function and significance of overseas investment insurance system, and then introduces the history of overseas investment insurance system in order to have a comprehensive understanding of overseas investment insurance system.The second part investigates and compares the overseas investment insurance system and MIGA of the major capital exporting countries.This paper first introduces the mature overseas investment insurance system of the United States, Japan, Germany and the multilateral Investment guarantee Agency, and then makes a comparative analysis of the legislative practice of the United States, Japan, Germany and the multilateral Investment guarantee Agency.In order to provide an effective reference for the establishment and improvement of overseas investment insurance system in China.The third part is the current situation and problems of overseas investment insurance system in China.This paper mainly introduces the present situation and existing problems of overseas investment insurance system in China, and analyzes the necessity and possibility of establishing overseas investment insurance system in China.The fourth part is the legislative conception of China's overseas investment insurance system.This chapter focuses on the mode selection of overseas investment insurance system, the monism and dualism of underwriting institution, qualified overseas investors and qualified overseas investment.At the same time, on the basis of comparative analysis, this paper puts forward the design ideas of the corresponding problems in the construction of China's overseas investment insurance system.
