【摘要】：爭議海域是存在國家間權(quán)利主張沖突的海域。權(quán)威文件的過度詮釋和不合理性以及美國亞太戰(zhàn)略的轉(zhuǎn)型等因素導(dǎo)致了南海爭議海域的形成。我國在南海爭議海域的維權(quán)必須考慮維權(quán)任務(wù)、維權(quán)范圍以及維權(quán)裝備等方面的特殊性,現(xiàn)實(shí)中面臨國際公約不完善、維權(quán)環(huán)境復(fù)雜以及法律依據(jù)不充分等困境。為此,在遵循國家主權(quán)利益至上以及和平利用海洋資源等原則的基礎(chǔ)上,我國應(yīng)通過完善依據(jù)、強(qiáng)化力量、構(gòu)建程序以及促進(jìn)兩岸合作等,加強(qiáng)南海爭議海域的維權(quán)。
[Abstract]:The disputed area is the area where there is a conflict of rights between states.The overinterpretation and irrationality of authoritative documents and the transformation of American Asia-Pacific strategy led to the formation of the disputed waters in the South China Sea.China's rights protection in the disputed waters of the South China Sea must take into account the particularity of the task, scope and equipment of safeguarding rights. In reality, China faces the dilemma of imperfect international conventions, complex environment for safeguarding rights and inadequate legal basis.Therefore, on the basis of following the principles of the supremacy of national sovereignty and the peaceful use of marine resources, China should strengthen its rights in the disputed waters of the South China Sea by perfecting the basis, strengthening its strength, constructing procedures and promoting cross-strait cooperation.
