【摘要】：雙重遺產(chǎn)是融合自然遺產(chǎn)和文化遺產(chǎn)特色于一體的世界遺產(chǎn),作為自然鬼斧神工的杰作和人類智慧文明的結(jié)晶,它是全人類共同的財(cái)富,對(duì)于研究歷史、保持生物多樣性、推進(jìn)全球社會(huì)、經(jīng)濟(jì)和環(huán)境的可持續(xù)發(fā)展有重要的自然和人文價(jià)值。近年來,商業(yè)開發(fā)扭曲了雙重遺產(chǎn)管理與保護(hù)的目的,經(jīng)濟(jì)發(fā)展的要求和人財(cái)物力的不足也為遺產(chǎn)保護(hù)工作也帶來了更多難題。考慮到雙重遺產(chǎn)的稀缺性、不可再造性以及其面臨的巨大壓力,雙重遺產(chǎn)的保護(hù)迫在眉睫,我國面臨著“進(jìn)亦難,退亦難”的尷尬局面。而分析我國對(duì)雙重遺產(chǎn)保護(hù)不力的根本原因,就是世界遺產(chǎn)保護(hù)法律制度的缺失。完善世界遺產(chǎn)的法律保護(hù)體系是加強(qiáng)雙重遺產(chǎn)保護(hù)的必然途徑,是維護(hù)自然資源和文化資源可持續(xù)發(fā)展的必然道路。本文以雙重遺產(chǎn)法律保護(hù)的完善為主題,分五個(gè)部分進(jìn)行逐步深入的分析論述。 第一章主要對(duì)雙重遺產(chǎn)的基本概念進(jìn)行界定,對(duì)其作為珍貴自然和文化資源的特點(diǎn)進(jìn)行歸納,明確基本問題,為下文論述的展開做鋪墊。 第二章以國際上對(duì)雙重遺產(chǎn)的保護(hù)為內(nèi)容,首先介紹世界雙重遺產(chǎn)的分布、面臨的危機(jī)以及保護(hù)的意義等概況,然后對(duì)雙重遺產(chǎn)保護(hù)的國際公約和機(jī)構(gòu)進(jìn)行歸納,最后指出雙重遺產(chǎn)現(xiàn)有保護(hù)體系中存在的缺陷。 第三章立足國際,對(duì)幾個(gè)世界遺產(chǎn)保護(hù)大國的相關(guān)法律體制進(jìn)行剖析,尋找其成功的共性,以期為我國雙重遺產(chǎn)法律保護(hù)的完善所用。 第四章轉(zhuǎn)入國內(nèi),先對(duì)我國的雙重遺產(chǎn)及其法律保護(hù)狀況進(jìn)行概述,然后以武夷山為例,系統(tǒng)介紹其擁有的自然和文化遺產(chǎn),分析現(xiàn)有的法律保護(hù)內(nèi)容,研究在武夷山法律保護(hù)中存在哪些矛盾。最后從武夷山的狀況引申,剖析我國雙重遺產(chǎn)法律保護(hù)的缺陷。 第五章是本文的總結(jié)部分,在前四章充分論證的基礎(chǔ)上,提出完善我國雙重遺產(chǎn)法律保護(hù)的建議。首先要制定一部世界遺產(chǎn)保護(hù)法,然后針對(duì)我國雙重遺產(chǎn)保護(hù)存在的其他問題,結(jié)合國際成功經(jīng)驗(yàn),提出與專門法相配合的一系列制度,以期建立完善的雙重遺產(chǎn)法律保護(hù)體系。
[Abstract]:Dual heritage is a world heritage that combines the characteristics of natural and cultural heritage, as a masterpiece of natural artistry and the crystallization of human intellectual civilization, it is the common wealth of all mankind, for the study of history, to maintain biodiversity,The promotion of global social, economic and environmental sustainable development has important natural and human value.In recent years, commercial development has distorted the purpose of dual heritage management and protection, and the requirements of economic development and the shortage of human and material resources have also brought more problems to the protection of heritage.In view of the scarcity of dual heritage, the irreproducibility and the enormous pressure it faces, the protection of dual heritage is urgent, and China is faced with the awkward situation of "advance is difficult, retreat is difficult".The fundamental reason for the weak protection of dual heritage in China is the lack of legal system for the protection of world heritage.To perfect the legal protection system of world heritage is an inevitable way to strengthen the protection of dual heritage and an inevitable way to maintain the sustainable development of natural and cultural resources.In this paper, the improvement of dual heritage legal protection as the theme, divided into five parts to analyze and discuss step by step.The first chapter mainly defines the basic concept of dual heritage, summarizes its characteristics as a precious natural and cultural resource, clarifies the basic problems, and paves the way for the following discussion.The second chapter introduces the distribution, crisis and significance of the protection of dual heritage in the world, and then summarizes the international conventions and institutions for the protection of dual heritage.Finally, the defects in the existing protection system of dual heritage are pointed out.The third chapter, based on the international, analyzes the relevant legal system of several big countries of the world heritage protection, looking for its successful commonality, in order to perfect the legal protection of the double heritage in our country.The fourth chapter introduces the dual heritage and its legal protection, then takes Wuyishan as an example, systematically introduces its natural and cultural heritage, and analyzes the existing legal protection content.What contradictions exist in the legal protection of Wuyishan.Finally, from the situation of Wuyi Mountain, it analyzes the defects of legal protection of double heritage in our country.The fifth chapter is the summary part of this paper, on the basis of the full demonstration in the first four chapters, it puts forward the suggestion of perfecting the legal protection of dual heritage in our country.First of all, it is necessary to formulate a World Heritage Protection Act. Then, in view of the other problems existing in China's dual heritage protection, and in the light of the successful international experience, a series of systems that are compatible with the special laws are put forward.In order to establish a perfect legal protection system of dual heritage.
