【摘要】：近年、區(qū)域貿(mào)易協(xié)定(RTA)、以及基于RTA而蓬勃發(fā)展的區(qū)域貿(mào)易集團(tuán)與全球治理之間關(guān)系的論辯成為研究的熱點(diǎn)。區(qū)域經(jīng)濟(jì)一體化與全球治理在歷史的長河中一直是并進(jìn)發(fā)展。在未來的發(fā)展過程中兩者會是怎樣的一種·發(fā)展趨勢?看清這一點(diǎn)有利于對全球貿(mào)易自由化進(jìn)程中區(qū)域經(jīng)濟(jì)一體化的制度進(jìn)行合理的安排。本文以探尋"RTA投資規(guī)則及其爭端解決機(jī)制與全球治理的關(guān)系”為研究目標(biāo),整理國內(nèi)外研究進(jìn)程中的相關(guān)部分集中闡述,試圖在區(qū)域經(jīng)濟(jì)合作與全球治理之間尋求有利于彼此雙贏互動的協(xié)調(diào)機(jī)制,從而推進(jìn)全球貿(mào)易自由化的發(fā)展進(jìn)程,為實(shí)現(xiàn)全球貿(mào)易的自由化目標(biāo)提供可以實(shí)行的有效途徑,并為我國更好的適應(yīng)與利用RTA投資規(guī)則及其爭端解決機(jī)制與全球治理之間的關(guān)系提出策略建議。 在RTA迅猛發(fā)展的今天,我們面臨的已經(jīng)不僅僅是否要參與區(qū)域經(jīng)濟(jì)一體化的問題,而是如何更好地其與全球治理的關(guān)系。分析RTA在投資規(guī)則、爭端解決機(jī)制等方面的特點(diǎn),研究RTA與全球治理的關(guān)系以及其在全球治理框架下可能出現(xiàn)的新發(fā)展,具有重要意義：一是可以掌握區(qū)域貿(mào)易協(xié)定發(fā)展的規(guī)律并發(fā)現(xiàn)其影響因素,為調(diào)整以后的區(qū)域合作方向提供經(jīng)驗和依據(jù),有利于向更大規(guī)模更高水平發(fā)展。二是有助于正確把握世界經(jīng)濟(jì)發(fā)展的大趨勢,對于在全球治理和區(qū)域經(jīng)濟(jì)一體化背景下提升我國參與區(qū)域經(jīng)濟(jì)合作的整體競爭力和全球管理具有重要意義。 為此,本文將分五個部分來對RTA投資規(guī)則與爭端解決機(jī)制與全球治理的關(guān)系這一問題作出詳細(xì)的分析。 第一部分,本章主要內(nèi)容是從理論角度,闡述了區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制的起源、產(chǎn)生的歷史背景,并分析了區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制的特征及發(fā)展趨勢。 第二部分,本章主要內(nèi)容主要分析全球治理興起的各種現(xiàn)實(shí)因素,對全球治理的構(gòu)成要素、核心概念、模式劃分及特征,以及全球治理的發(fā)展前景等進(jìn)行了探討。 第三部分,本章主要內(nèi)容主要分析了區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制與全球治理的辯證關(guān)系,詳細(xì)闡述了區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制對全球治理的產(chǎn)生的積極影響和消極影響。 第四部分,本章主要內(nèi)容主要分析了本章主要內(nèi)容主要從環(huán)境保護(hù)和投資規(guī)則的關(guān)系闡述投資規(guī)則及爭端解決機(jī)制與全球治理關(guān)系的新發(fā)展。 第五部分,本章的主要內(nèi)容分析了中國就區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制與全球治理的辯證關(guān)系應(yīng)采取對策,通過分析中國參與的各種區(qū)域貿(mào)易協(xié)定及中國與全球治理的關(guān)系,提出了中國如何適應(yīng)區(qū)域貿(mào)易協(xié)定投資規(guī)則及爭端解決機(jī)制與全球治理的辯證關(guān)系,適時參與全球治理的相關(guān)建議。
[Abstract]:In recent years, regional trade agreements (RTAs) and the relationship between regional trade groups (RTAs) and global governance based on RTA have become a hot research topic.Regional economic integration and global governance have been developing side by side in the long history.What kind of development trend will both be in the future development process?It is advantageous to arrange the system of regional economic integration in the process of global trade liberalization.This paper aims at exploring the relationship between RTA investment rules and its dispute settlement mechanism and global governance, and summarizes the relevant parts of the research process at home and abroad.Attempting to seek coordination mechanisms between regional economic cooperation and global governance that are conducive to mutual win-win interaction in order to advance the development process of global trade liberalization and provide an effective way to achieve the goal of global trade liberalization,Some suggestions are put forward for our country to adapt and utilize the RTA investment rules and the relationship between the dispute settlement mechanism and global governance.With the rapid development of RTA, we are faced with not only whether to participate in regional economic integration, but also how to better its relationship with global governance.This paper analyzes the characteristics of RTA in the aspects of investment rules and dispute settlement mechanism, studies the relationship between RTA and global governance and its possible new development under the framework of global governance.It is of great significance: first, we can grasp the law of the development of regional trade agreements and find out its influencing factors, which can provide experience and basis for adjusting the direction of regional cooperation, and help to develop to a higher level on a larger scale.Second, it is helpful to correctly grasp the general trend of world economic development, which is of great significance to enhance the overall competitiveness and global management of China's participation in regional economic cooperation under the background of global governance and regional economic integration.Therefore, this paper will make a detailed analysis of the relationship between RTA investment rules and dispute settlement mechanism and global governance in five parts.The first part, the main content of this chapter is from the theory angle, elaborated the regional trade agreement investment rule and the dispute settlement mechanism origin, the historical background which produces,The characteristics and development trend of investment rules and dispute settlement mechanism of RTAs are also analyzed.In the second part, the main content of this chapter mainly analyzes the various realistic factors of the rise of global governance, discusses the elements of global governance, core concepts, model division and characteristics, as well as the development prospects of global governance.In the third part, the main content of this chapter mainly analyzes the dialectical relationship between the investment rules of RTAs and the dispute settlement mechanism and global governance.The positive and negative effects of investment rules and dispute settlement mechanism of RTAs on global governance are discussed in detail.In the fourth part, the main content of this chapter mainly analyzes the new development of the relationship between investment rules and dispute settlement mechanism and global governance from the relationship between environmental protection and investment rules.In the fifth part, the main content of this chapter analyzes that China should take countermeasures on the dialectical relationship between regional trade agreement investment rules and dispute settlement mechanism and global governance.By analyzing the regional trade agreements China participates in and the relationship between China and global governance, this paper puts forward how China adapts to the investment rules of regional trade agreements and the dialectical relationship between the dispute settlement mechanism and global governance.Timely participation in global governance recommendations.
