【摘要】：本文從碳排放量的限制起因與建立國際經(jīng)濟(jì)新秩序之間的微妙關(guān)系分析入手,對在發(fā)達(dá)國家之間的碳排放量博弈與發(fā)達(dá)國家和發(fā)展中國家的碳排放量博弈進(jìn)行研究,進(jìn)而探討中國的發(fā)展情況,并對相應(yīng)的法律體系進(jìn)行梳理。同時詳細(xì)比較歐美等發(fā)達(dá)國家和地區(qū)對碳排量限制的立法和實(shí)踐情況,提出我國在碳排量方面法律規(guī)制的完善建議以及在建立國際經(jīng)濟(jì)秩序方面的作用。文章從發(fā)達(dá)國家與發(fā)展中家對待《京都議定書》的態(tài)度,從國家碳排放利益的博弈進(jìn)行論述,通過歐美法律規(guī)制的比較,進(jìn)而提出我國應(yīng)采取相應(yīng)措施的結(jié)論。 文章大致從六個部分,對各國碳排放博弈情況與建立國際經(jīng)濟(jì)新秩序的進(jìn)程和二者之間的關(guān)系進(jìn)行研究,并深入探討了對各國的影響： 第一部分,通過解讀各排放利益集團(tuán)在簽訂《京都議定書》前后的態(tài)度變化和中美兩國面對《京都議定書》所堅(jiān)持的立場對國際碳減排進(jìn)行綜合概述。 第二部分,以中國視角看國際碳減排,就是在維護(hù)中國發(fā)展權(quán)視角下探討碳減排的方法和策略,并提出我國的建議和意見。 第三部分,通過對歐美碳交易市場的法律規(guī)則進(jìn)行國際比較,總結(jié)經(jīng)驗(yàn)進(jìn)行借鑒,以此來完善我國的相關(guān)法律法規(guī)。 最后一部分,通過研習(xí)《坎昆會議》對碳減排提出的建議對未來氣候變化國際立法發(fā)生積極的影響,提出我國的應(yīng)對策略和措施。
[Abstract]:Based on the analysis of the subtle relationship between the limitation of carbon emissions and the establishment of a new international economic order, this paper studies the game of carbon emissions between developed countries and developed and developing countries.Then the development of China is discussed, and the corresponding legal system is combed.At the same time, the legislation and practice of carbon emission limitation in developed countries and regions such as Europe and America are compared in detail, and the suggestions on how to improve the legal regulation of carbon emission in China and the role in the establishment of international economic order are put forward.This paper discusses the attitude of developed countries and developing countries towards the Kyoto Protocol, discusses the game of national carbon emission benefits, and puts forward the conclusion that China should take corresponding measures through the comparison of European and American laws and regulations.From six parts, the paper studies the process of establishing a new international economic order and the process of establishing a new international economic order, and discusses the influence on each country deeply.In the first part, the author gives a comprehensive overview of the international carbon abatement by interpreting the changes of the attitudes of the emission interest groups before and after the signing of the Kyoto Protocol and the position that China and the United States adhere to in the face of the Kyoto Protocol.The second part, from the perspective of China, discusses the methods and strategies of carbon abatement from the perspective of safeguarding China's right to development, and puts forward our suggestions and suggestions.The third part, through the international comparison of the European and American carbon trading market laws and regulations, summarizes the experience for reference, in order to improve the relevant laws and regulations of our country.In the last part, through the study of Cancun Conference on carbon abatement, which has a positive effect on the future international legislation on climate change, the countermeasures and measures of our country are put forward.
