【摘要】：隨著中國經(jīng)濟(jì)的快速發(fā)展以及我國綜合國力的提升,人民幣國際化問題引起了廣泛的關(guān)注,成為理論研究的熱點(diǎn)和前沿。 在IMF(國際貨幣基金組織)改革呼聲高漲的同時(shí),中國金融貨幣體系也在經(jīng)歷巨大的變革,在人民幣實(shí)現(xiàn)了經(jīng)常項(xiàng)目下可自由兌換之后,隨著中國經(jīng)濟(jì)的發(fā)展,逐步地邁向國際化,人民幣國際化的問題也被人們廣泛關(guān)注。不可否認(rèn)的是,人民幣國際化之后會(huì)給我國帶來諸多益處,但是,在國際金融貨幣體系并不穩(wěn)定的今天,人民幣國際化是否會(huì)對我國經(jīng)濟(jì)發(fā)展帶來巨大的沖擊,這是需要我們密切關(guān)注的問題。因此,我們需要在IMF改革以及我國經(jīng)濟(jì)的發(fā)展過程中,防范人民幣在國際化進(jìn)程中可能出現(xiàn)的風(fēng)險(xiǎn),從法律制度上保障人民幣安全、漸進(jìn)地走向國際化。 本文除引言結(jié)語以外,共有四個(gè)部分: 第一部分,IMF框架下國際貨幣法律制度概述。主要介紹了IMF國際貨幣法律制度的形成背景;國際貨幣法律制度的具體內(nèi)容,包括國際貨幣的定義、國際貨幣制度、國際貨幣的本質(zhì)和特征;國際貨幣法律制度的演進(jìn);國際貨幣基金組織目前的改革以及與人民幣國際化的關(guān)系。 第二部分,介紹了人民幣國際化的必要性,對人民幣國際化的可行性進(jìn)行了分析,最后介紹了理論界普遍認(rèn)可的人民幣國際化的路徑。 第三部分,對人民幣國際化相關(guān)法律制度現(xiàn)狀進(jìn)行了分析,找出其存在的問題。具體包括人民幣經(jīng)常項(xiàng)目和資本項(xiàng)目現(xiàn)狀,與人民幣國際化相關(guān)的金融法律制度的現(xiàn)狀。 第四部分,提出在IMF框架下推進(jìn)人民幣國際化的法律對策。明確了人民幣國際化應(yīng)遵循漸進(jìn)性和安全性的原則;完善相關(guān)金融法律制度;在IMF改革中找到有利于人民幣國際化的立足點(diǎn),推動(dòng)人民幣國際化;提出我國應(yīng)通過簽訂國際條約推動(dòng)人民幣國際化進(jìn)程;最后提出加強(qiáng)金融監(jiān)管的國際合作確保人民幣國際化過程中的金融安全。
[Abstract]:With the rapid development of China's economy and the improvement of China's comprehensive national strength, the internationalization of RMB has attracted wide attention and become a hot spot and frontier of theoretical research.At the same time as the IMF (International Monetary Fund) reform is rising, China's financial and monetary system is undergoing tremendous changes. After the RMB has been freely convertible under the current account, with the development of the Chinese economy,Step by step towards internationalization, the issue of RMB internationalization has been widely concerned.It is undeniable that the internationalization of the RMB will bring many benefits to China after its internationalization. However, with the instability of the international financial and monetary system, will the internationalization of the RMB bring a huge impact on the economic development of our country?This is an issue that requires our close attention.Therefore, in the process of IMF reform and the development of China's economy, we need to guard against the risks that may arise in the process of RMB internationalization, guarantee the security of RMB from the legal system, and gradually move towards internationalization.In addition to the introduction to the conclusion of this article, there are four parts:The first part is an overview of the international monetary legal system under the IMF framework.This paper mainly introduces the background of the formation of the international monetary legal system of IMF, the specific contents of the legal system of international monetary, including the definition of international currency, the international monetary system, the essence and characteristics of the international monetary system, the evolution of the international monetary legal system, and the development of the international monetary legal system.The current reform of the IMF and its relationship with the internationalization of the renminbi.In the second part, the necessity of RMB internationalization is introduced, the feasibility of RMB internationalization is analyzed, and the path of RMB internationalization is introduced.In the third part, the author analyzes the current situation of RMB internationalization and finds out the existing problems.It includes the current account and capital account of RMB, and the status of financial legal system related to RMB internationalization.The fourth part puts forward the legal countermeasures to promote the internationalization of RMB under the framework of IMF.It is clear that RMB internationalization should follow the principles of gradual development and safety, perfect the relevant financial legal system, find a foothold conducive to RMB internationalization in the reform of IMF, and promote RMB internationalization.It is suggested that China should promote the process of RMB internationalization by signing international treaties, and finally, strengthen the international cooperation of financial supervision to ensure the financial security in the process of RMB internationalization.
