【摘要】：隨著我國(guó)境外公民數(shù)量的日益增多,加之受國(guó)際地緣政治等因素的影響而導(dǎo)致的各種沖突和非傳統(tǒng)威脅,我國(guó)現(xiàn)行的境外公民保護(hù)機(jī)制面臨著前所未有的壓力和挑戰(zhàn)。為了更好地保護(hù)我國(guó)境外公民的各種權(quán)益,我國(guó)應(yīng)當(dāng)在境外公民保護(hù)機(jī)制的定位、框架、法律環(huán)境以及運(yùn)行等方面進(jìn)行重新考量及優(yōu)化,即在保護(hù)機(jī)制的定位上由重點(diǎn)保護(hù)生命財(cái)產(chǎn)安全轉(zhuǎn)向全面保護(hù)合法權(quán)益,在保護(hù)機(jī)制的框架上倚仗國(guó)家、社團(tuán)、公民三個(gè)層面的支撐,在保護(hù)機(jī)制的法律環(huán)境上體現(xiàn)習(xí)慣法的更新和人權(quán)化的拓展,在保護(hù)機(jī)制的運(yùn)行上體現(xiàn)制度的保障和結(jié)構(gòu)性修補(bǔ)。
[Abstract]:With the increasing number of citizens outside our country, coupled with various conflicts and non-traditional threats caused by factors such as international geopolitics, In order to better protect the rights and interests of foreign citizens, our country should position and frame the protection mechanism of overseas citizens. The legal environment and operation should be reconsidered and optimized, that is to say, the orientation of the protection mechanism should be shifted from protecting life and property safety to fully protecting the legitimate rights and interests, and relying on the state and the community on the framework of the protection mechanism. The three levels of citizen support reflect the renewal of customary law and the expansion of human rights in the legal environment of the protection mechanism, and the guarantee and structural repair of the system in the operation of the protection mechanism.
