【摘要】:透明度原則作為世界貿(mào)易組織組織的基本原則之一,對于建立一個完整、更可行的、持久的多邊貿(mào)易體制具有至關(guān)重要的作用。我國自加入世界貿(mào)易組織以來,在政府職能轉(zhuǎn)變和行政公開方面已經(jīng)取得了一定的成績。取得成績的同時,我們也必須清醒的認(rèn)識到我國當(dāng)前透明度實踐同WTO透明度原則的要求和發(fā)達(dá)國家所取得的成就相比,仍存在一定差距。本文主要通過對WTO框架下的透明度標(biāo)準(zhǔn)的探討以及對代表國家落實透明度原則實踐的介紹,對我國如何構(gòu)建更加透明的行政公開體系提出自己的觀點。 本文共分為緒言、正文、結(jié)語三個部分。正文分為四章。 第一章主要是WTO透明度原則的概述。從WTO透明度原則的概念入手,深入分析WTO協(xié)定中透明度原則的內(nèi)涵和它存在的法理基礎(chǔ),并選取WTO協(xié)定中一些有關(guān)透明度原則的代表性條款加以介紹,以期更直觀的呈現(xiàn)WTO協(xié)定中透明度原則的具體要求。隨后,本章回顧了WTO透明度原則的歷史沿革,詳細(xì)介紹了WTO中透明度原則的發(fā)展歷程。 第二章主要圍繞WTO協(xié)定中的透明度標(biāo)準(zhǔn)進(jìn)行論述。本章首先通過介紹成員國根據(jù)WTO協(xié)定應(yīng)履行的透明度義務(wù),系統(tǒng)剖析WTO協(xié)定中透明度原則及其例外情形的一般標(biāo)準(zhǔn)。隨后,本章結(jié)合WTO中已出現(xiàn)的涉及透明度原則案例中的專家組或上訴機(jī)構(gòu)報告,對透明度原則的核心條款——GATT1994第10條進(jìn)行了解讀,以期更深入揭示條款內(nèi)涵和立法原意,進(jìn)一步明確WTO協(xié)定中的透明度標(biāo)準(zhǔn),為今后能更好的理解和運(yùn)用相關(guān)條款提供幫助。 第三章主要探討了美國、日本國內(nèi)法在履行透明度義務(wù)方面的實踐。分別以兩國的政府信息公開體系為主體,全面介紹了這些代表國家在落實透明度義務(wù)方面的立法和行政實踐,以及這些實踐本身對于貫徹透明度原則的意義。這些國家均為法治發(fā)達(dá)國家,他們的相關(guān)實踐可以作為國內(nèi)法上履行透明度義務(wù)的最佳典范,其中的先進(jìn)經(jīng)驗值得我國學(xué)習(xí)與借鑒。 第四章立足我國當(dāng)前的行政公開體系,對我國在履行透明度義務(wù)方面面臨的挑戰(zhàn)進(jìn)行了分析,分別從立法和行政實踐層面揭示了我國目前在貫徹透明度原則方面存在的不足,進(jìn)而提出迎接這一挑戰(zhàn)的應(yīng)對策略。對于如何構(gòu)建更加透明的信息公開體系提出了自己的初步思考。
[Abstract]:As one of the fundamental principles of the World Trade Organization, the principle of transparency plays a vital role in the establishment of a complete, more viable and lasting multilateral trading system. Some achievements have been made in the transformation of government functions and administrative openness. At the same time, we must also realize clearly that the current transparency practice in China is compared with the requirements of the WTO transparency principle and the achievements of developed countries. There is still a certain gap. This paper mainly discusses the transparency standards under the framework of WTO and introduces the practice of implementing transparency principles on behalf of the country, and puts forward its own views on how to build a more transparent administrative disclosure system in China. This paper is divided into three parts: introduction, text and conclusion. The text is divided into four chapters. The first chapter is an overview of WTO transparency principle. Starting with the concept of WTO transparency principle, the connotation and legal basis of transparency principle in WTO agreement are analyzed. Some representative articles about transparency principle in WTO agreement are introduced in order to present the specific requirements of transparency principle in WTO agreement more intuitively. Subsequently, this chapter reviews the history of transparency principle of WTO. The development of transparency principle in WTO is introduced in detail. The second chapter mainly discusses the transparency standards in the WTO Agreement. Firstly, this chapter systematically analyzes the general standards of transparency principles and exceptions in the WTO Agreement by introducing the transparency obligations of member States under the WTO Agreement. This chapter interprets the core clause of the transparency principle, Article 10 of GATT1994, according to the reports of expert groups or appellate bodies that have appeared in the cases involving transparency principles in WTO, in order to reveal the connotation and legislative intent of the articles more deeply. Further clarify the transparency standards in the WTO Agreement to help better understand and apply the relevant provisions in the future. The third chapter mainly discusses the practice of the United States and Japan in fulfilling their transparency obligations. Having provided a comprehensive description of the legislative and administrative practices of these representative States in implementing the obligation to transparency, as well as the significance of those practices themselves for the implementation of the principle of transparency, all of which are developed by the rule of law, Their relevant practice can be regarded as the best model to fulfill the transparency obligation in the domestic law, and the advanced experience among them is worthy of our country to learn and draw lessons from. The fourth chapter is based on the current administrative openness system of our country, analyzes the challenges that our country faces in fulfilling the transparency obligation, and reveals the shortcomings of implementing the transparency principle in our country from the aspects of legislation and administrative practice, respectively. Finally, the paper puts forward some countermeasures to meet this challenge, and puts forward some preliminary thoughts on how to construct a more transparent information disclosure system.
