【摘要】：上海、廣東、天津和福建自由貿(mào)易試驗區(qū)(以下簡稱"自貿(mào)試驗區(qū)")的管理行為的國際法效果歸于中國政府,因此其制度創(chuàng)新需建立在國際合法性的基礎(chǔ)之上。就發(fā)達(dá)國家關(guān)注的貿(mào)易政策合規(guī)、知識產(chǎn)權(quán)保護(hù)和"社會傾銷"等涉及貿(mào)易公平的問題,四大自貿(mào)試驗區(qū)需要在內(nèi)化實施《補貼與反補貼協(xié)定》《與貿(mào)易有關(guān)的投資措施協(xié)定》及《與貿(mào)易有關(guān)的知識產(chǎn)權(quán)協(xié)定》方面充當(dāng)表率,在強化知識產(chǎn)權(quán)的邊境保護(hù)發(fā)揮引領(lǐng)作用。自貿(mào)試驗區(qū)有必要在加強勞動標(biāo)準(zhǔn)的實施方面有所創(chuàng)新,以消除國際社會對中國所謂的"社會傾銷"的顧慮。同時,基于大陸和臺灣同為WTO成員的事實,福建自貿(mào)試驗區(qū)推進(jìn)兩岸深度合作的相關(guān)立法作為國內(nèi)安排,需注意不違反WTO的非歧視規(guī)則,避開貿(mào)易方面的特別優(yōu)惠。
[Abstract]:The effects of international law on the management of the free trade test areas in Shanghai, Guangdong, Tianjin and Fujian (hereinafter referred to as the "free trade test zones") are attributable to the Chinese government. Therefore, its institutional innovation needs to be based on international legitimacy... With regard to trade policy compliance, intellectual property protection and "social dumping" that developed countries are concerned about, The four FTAs need to serve as an example in internalizing the implementation of the Agreement on subsidies and countervailing measures and the Agreement on Trade-Related aspects of intellectual property Rights, To play a leading role in strengthening the border protection of intellectual property rights. It is necessary for the FTAZ to innovate in strengthening the implementation of labour standards in order to allay the concerns of the international community about China's so-called "social dumping". At the same time, Based on the fact that the mainland and Taiwan are both members of the WTO, as a domestic arrangement, the relevant legislation of the Fujian Free Trade Test area to promote the deep cooperation between the two sides of the Taiwan Strait should not violate the non-discrimination rules of the WTO and avoid the special trade preferences.
