【摘要】：Suprema Inc.v.ITC以及Clear Correct Operating LLC v.ITC昭示了美國(guó)337調(diào)查的最新發(fā)展。前者確認(rèn)了美國(guó)國(guó)際貿(mào)易委員會(huì)對(duì)引誘侵權(quán)行為享有管轄權(quán),而后者則否認(rèn)了數(shù)據(jù)資料為337調(diào)查的對(duì)象。兩起案件的關(guān)鍵均在于對(duì)關(guān)稅法337條款的解釋,這兩起案件對(duì)我國(guó)企業(yè)進(jìn)軍美國(guó)市場(chǎng)產(chǎn)生了重要影響。為了有效應(yīng)對(duì)337調(diào)查管轄范圍的最新發(fā)展,一方面,在國(guó)際談判中,我國(guó)政府應(yīng)當(dāng)對(duì)ITC擴(kuò)大行政職權(quán)與WTO貿(mào)易規(guī)則方面的沖突作出回應(yīng),并著力構(gòu)建"中國(guó)版的337調(diào)查"制度,以保證國(guó)內(nèi)產(chǎn)業(yè)安全;另一方面,我國(guó)企業(yè)應(yīng)當(dāng)加強(qiáng)知識(shí)產(chǎn)權(quán)管理,通過完善知識(shí)產(chǎn)權(quán)預(yù)警機(jī)制、專利布局等避免遭受337調(diào)查。
[Abstract]:Suprema Inc.v.ITC and Clear Correct Operating LLC v.ITC have highlighted the latest developments in the U. S. investigation. The former confirmed the jurisdiction of the US International Trade Commission over seduction violations, The latter denied that the data was the subject of the 337 investigation. The key to both cases was the interpretation of Section 337 of the Customs Act. These two cases have had an important impact on the entry of Chinese enterprises into the United States market. In order to effectively respond to the latest developments in the jurisdiction of the 337 investigation, on the one hand, in international negotiations, Our government should respond to the conflict between the expansion of the administrative authority of ITC and the trade rules of WTO, and make great efforts to construct the "Chinese version of 337 investigation" system to ensure the safety of domestic industries, on the other hand, our enterprises should strengthen the management of intellectual property rights. Through the improvement of intellectual property warning mechanism, patent layout and so on to avoid 337 investigation.
