【摘要】:本文從國際海事公約的基本問題出發(fā),探討國際海事公約在我國立法轉(zhuǎn)化的理論基礎(chǔ),在借鑒外國履約經(jīng)驗(yàn)的基礎(chǔ)上,提出我國履約立法存在的問題、立法建議和機(jī)制完善。除引言和結(jié)論外,本文正文包括6章。 第1章是國際海事公約與IMO履約審核機(jī)制。研究分析了國際海事公約的歷史與發(fā)展趨勢、IMO公約的基礎(chǔ)與分類以及相關(guān)術(shù)語,同時介紹了IMO履約審核機(jī)制的內(nèi)容和對IMO成員國的立法要求,提出IMO履約審核機(jī)制下我國海事履約立法轉(zhuǎn)化面臨的機(jī)遇與挑戰(zhàn)。 第2章是IMO審核機(jī)制下中國海事履約立法轉(zhuǎn)化的現(xiàn)狀分析。研究分析IMO公約在中國的立法轉(zhuǎn)化體系、轉(zhuǎn)化方式、局限性與典型IMO公約在中國履約立法的現(xiàn)狀,提出我國立法實(shí)踐與IMO審核標(biāo)準(zhǔn)之間的差距。 第3章是國際海事公約在中國立法轉(zhuǎn)化之基本理論。通過研究國際海事公約在各國立法轉(zhuǎn)化的前提,提出我國對公法性的國際海事公約立法轉(zhuǎn)化的前提是納入,闡述在我國建立“自執(zhí)行條約”和“非自執(zhí)行條約”的必要性與可行性。通過對國際海事公約與我國國內(nèi)法關(guān)系的分析,提出處理二者的沖突關(guān)系應(yīng)當(dāng)區(qū)分公約對我國生效前和生效后的不同情況進(jìn)行立法協(xié)調(diào)。 第4章是國際海事公約在其他國家和地區(qū)立法現(xiàn)狀與評價。通過分析采用“納入”方式的國家和采用“轉(zhuǎn)化”方式的國家履約立法現(xiàn)狀,對各國履約立法進(jìn)行綜合評價,并提出可供我國借鑒之處。 第5章是國際海事公約在我國立法轉(zhuǎn)化的不足與完善。通過前文對我國履約現(xiàn)狀的分析,提出我國履約立法存在立法理念滯后、法律規(guī)范缺失以及履約體系不完善等問題,從憲法、憲法性法律、海事立法以及部頒規(guī)范性文件的角度提出相關(guān)的立法建議,從文件化、信息化和制度化的角度構(gòu)建中國履約立法機(jī)制。
[Abstract]:Starting from the basic problems of international maritime conventions, this paper probes into the theoretical basis of the legislative transformation of international maritime conventions in China, and on the basis of drawing lessons from foreign performance experiences, puts forward the problems existing in China's compliance legislation. Besides introduction and conclusion, the text of this paper includes 6 chapters. The first chapter is the international maritime convention and the IMO performance audit mechanism. It studies and analyzes the history and development trend of the international maritime convention and the basis and classification of the IMO convention, as well as the related terminology. At the same time, this paper introduces the content of IMO compliance audit mechanism and the legislative requirements of IMO member countries, and puts forward the opportunities and challenges for the transformation of maritime performance legislation in China under the IMO performance audit mechanism. Chapter 2 is the analysis of the current situation of China's maritime compliance legislation transformation under the IMO audit mechanism. The research and analysis of the IMO Convention in China's legislative transformation system, transformation methods, limitations and typical IMO conventions in China's implementation legislation status, Put forward the gap between our legislative practice and IMO auditing standards. Chapter 3 is the basic theory of the legislative transformation of international maritime conventions in China. By studying the premise of the legislative transformation of international maritime conventions in various countries, the author points out that the premise of the legislative transformation of international maritime conventions of public law in our country is to be incorporated. This paper expounds the necessity and feasibility of establishing "self-enforcement treaty" and "non-self-enforcement treaty" in our country. Through the analysis of the relationship between international maritime conventions and China's domestic law, It is suggested that the legislative coordination between the two conflicts should be made between before and after the entry into force of the convention. Chapter 4 is the legislative status and evaluation of international maritime conventions in other countries and regions. And put forward the reference for our country. Chapter 5 is the deficiency and perfection of the international maritime convention's legislation transformation in our country. Based on the analysis of the present situation of our country's implementation, the author points out that the legislation of our country's compliance legislation is lagging behind, the legal norm is lacking and the performance system is not perfect, etc. From the angle of constitution, constitutional law, maritime legislation and the normative documents issued by the Ministry, this paper puts forward relevant legislative suggestions, and constructs the legislative mechanism of China's implementation from the perspective of document, information and institutionalization.
