中國海洋基本法研究

【摘要】:人類賴以生存的地球表面大約71%被海洋所覆蓋,世界人口一半以上居住在離海岸60千米以內(nèi)的沿海地區(qū),其中群島國家占了絕大部分。隨著人類對海洋認識的逐步深化,人們對海洋的依賴程度也日益增加。1982年第三次聯(lián)合國會議通過了《聯(lián)合國海洋法公約》(以下簡稱公約)。它作為聯(lián)合國頒布的第一部系統(tǒng)完善的海洋法規(guī),對世界各國的海洋政策具有普遍指導(dǎo)意義。它的產(chǎn)生為各國海權(quán)維護奠定了理論基礎(chǔ)。在世界海洋大國紛紛制定綜合型海洋立法趨勢下,中國海洋安全受到威脅,如何更好的開發(fā)利用海洋、維護海洋權(quán)益,則需要中國制定綜合型海洋法律。 本文首先運用了理論聯(lián)系實際的方法,即以海洋法理論為指導(dǎo),聯(lián)系本國國情國力,從而制定科學(xué)的海洋政策;其次通過對歷史教訓(xùn)的總結(jié)及對國外海洋立法發(fā)展?fàn)顩r對比的方法,看到海洋立法逐漸從單項立法走向綜合型立法的趨勢。面對這一立法趨勢,加強我國海洋法制建設(shè)的關(guān)鍵是盡早制定海洋基本法,以確保中國海洋權(quán)益的安全。 在體例安排上,由四部分組成。第1章介紹了主要沿海國家海洋經(jīng)濟的發(fā)展、國際海洋基本法的產(chǎn)生及發(fā)展趨勢;第2章分析了加拿大、日本、英國等國家的海洋立法,并以此為切入點,闡述了當(dāng)今各國海洋立法趨勢;第3章通過對中國海洋立法現(xiàn)狀的概述,分析了我國海洋立法存在的問題、制定海洋基本法的必要性及可行性;第4章在前幾章對比分析的基礎(chǔ)上提出了中國海洋基本法的主要內(nèi)容。 本文的論述有助于我國海洋大國的實現(xiàn),為我國海洋權(quán)益保護提供了現(xiàn)實的對策。
[Abstract]:About 71% of the earth's surface, on which mankind depends, is covered by oceans. More than half of the world's population lives in coastal areas less than 60 kilometers from the coast, with archipelagic countries accounting for most of them. In 1982, the third United Nations Conference on the Law of the Sea adopted the United Nations Convention on the Law of the Sea (hereinafter referred to as the Convention). It is of universal guiding significance to the marine policies of various countries in the world. Its emergence has laid a theoretical foundation for the maintenance of maritime rights in various countries. Under the trend of the major maritime powers in the world to formulate comprehensive marine legislation one after another, China's maritime security is threatened. How to better develop and utilize the ocean and safeguard its rights and interests requires China to formulate comprehensive marine laws. Firstly, this paper uses the method of integrating theory with practice, that is, taking the theory of the law of the sea as the guidance, connecting with the national conditions and national strength of our country, we can formulate a scientific ocean policy. Secondly, by summing up the historical lessons and comparing the development of foreign marine legislation, we can see that marine legislation is gradually moving from single legislation to comprehensive legislation. In order to ensure the safety of China's maritime rights and interests, the key to strengthen China's maritime legal system is to formulate the basic Law of the Sea as soon as possible. The first chapter introduces the development of the marine economy of the main coastal countries, the emergence and development trend of the international maritime basic law, the second chapter analyzes the maritime legislation of Canada, Japan, Britain and other countries. Chapter 3 analyzes the problems existing in China's marine legislation and the necessity and feasibility of formulating the basic law of the sea through the summary of the current situation of China's marine legislation. Chapter 4 puts forward the main contents of China's basic Law of the Sea on the basis of comparative analysis of the previous chapters. The discussion in this paper is helpful to the realization of marine power in China and provides practical countermeasures for the protection of marine rights and interests in China.
