【摘要】：當前,全球經(jīng)濟進入了一體化時期,各國經(jīng)濟飛速增長,在為各國帶來利潤的同時,也對環(huán)境造成了嚴重的污染與破壞。環(huán)境問題日益突出,引起了全球人類的高度關注。在國與國,地區(qū)與地區(qū)的經(jīng)濟活動日益密切的今天,跨界環(huán)境影響評價制度顯得尤為重要。跨界環(huán)境影響評價制度作為國際環(huán)境保護法的一項重要制度,其產(chǎn)生至今已有20多年的歷史,但其實施現(xiàn)狀卻不盡如人意。“徒法不足以自行”,跨界環(huán)境影響評價制度的實施問題不解決,有關跨界環(huán)境影響評價制度的國際立法便成為一紙空文,該制度預防跨界環(huán)境損害及保護環(huán)境的作用也難以發(fā)揮。本文首先介紹了跨界環(huán)境影響評價制度的基本內(nèi)容,然后介紹了該制度在的理論研究現(xiàn)狀及實施中存在的問題,進行具體分析并提出了解決方案,最后介紹了我國有關跨界環(huán)境影響評價制度的研究狀況。

In the country and country, the region and the region economic activity is increasingly close today, As an important system of international environmental protection law, transboundary environmental impact assessment system has a history of more than 20 years. However, the present situation of its implementation is not satisfactory. "the law is not sufficient for itself." if the implementation of the transboundary environmental impact assessment system is not resolved, the international legislation on the transboundary environmental impact assessment system will become a dead letter. This paper introduces the basic contents of the transboundary environmental impact assessment system, and then introduces the present situation of the theoretical research and the problems existing in the implementation of the system. At last, the paper introduces the research status of transboundary environmental impact assessment system in China.
