【摘要】：隨著貿(mào)易自由化的不斷發(fā)展，我國的對外貿(mào)易對世界貿(mào)易的影響也日益加深。這種經(jīng)濟(jì)貿(mào)易的發(fā)展也伴隨著人們的道德意識的提高和社會責(zé)任感的加強(qiáng)，由此勞工標(biāo)準(zhǔn)也越來越受到各國的關(guān)注，已成為WTO的三大熱門話題之一。在發(fā)達(dá)國家與發(fā)展中國家之間關(guān)于勞工標(biāo)準(zhǔn)問題矛盾激增。發(fā)達(dá)國家為了擺脫國內(nèi)經(jīng)濟(jì)增長的困境，防止發(fā)展中國家產(chǎn)品對其國內(nèi)產(chǎn)業(yè)的沖擊，努力將勞工標(biāo)準(zhǔn)與國際貿(mào)易掛鉤，，雖然勞工標(biāo)準(zhǔn)還沒有納入WTO多邊規(guī)則中去但已經(jīng)在區(qū)域貿(mào)易協(xié)定中出現(xiàn)，勞工標(biāo)準(zhǔn)已然成為一種新的貿(mào)易壁壘之一，而發(fā)展中國家則極力反對將國際勞工標(biāo)準(zhǔn)與貿(mào)易掛鉤。因為這會加大勞動力成本對我國以出口導(dǎo)向型為主的勞動密集型產(chǎn)業(yè)的發(fā)展有著巨大的影響。在這樣的時代背景下，研究國際勞工標(biāo)準(zhǔn)對于我國的對外經(jīng)濟(jì)貿(mào)易法律規(guī)則與國內(nèi)勞工立法，即具有理論意義，又具有實踐意義。 本文力圖利用數(shù)據(jù)，通過實證的角度分析貿(mào)易自由化下的國際勞工標(biāo)準(zhǔn)的成因、本質(zhì)、對策。客觀分析了國際勞工標(biāo)準(zhǔn)對我國對外貿(mào)易的影響及國際勞工標(biāo)準(zhǔn)在國內(nèi)的現(xiàn)實狀況，并且基于國內(nèi)立法體系不完善，執(zhí)法不嚴(yán)等法律方面的不足進(jìn)行了分析，提出了對策建議。希望本文能夠?qū)ξ覈鴦诠?biāo)準(zhǔn)的實踐提供有益的幫助和參考。
[Abstract]:With the development of trade liberalization, the influence of China's foreign trade on world trade is deepening. The development of this kind of economy and trade is accompanied by the improvement of people's moral consciousness and the strengthening of social responsibility. As a result, labor standards have become one of the three hot topics in the WTO. In order to get rid of the predicament of domestic economic growth, the contradiction of labor standards between developed and developing countries has increased rapidly. To prevent the impact of the products of developing countries on their domestic industries and to try to link labour standards to international trade, although labour standards have not yet been incorporated into the multilateral rules of the WTO, they have emerged in regional trade agreements, Labor standards have become one of the new barriers to trade. Developing countries, on the other hand, strongly oppose linking international labour standards to trade, because this will increase labor costs and have a huge impact on the development of China's export-oriented labor-intensive industries. The study of international labor standards is of both theoretical and practical significance for China's foreign economic and trade laws and domestic labor legislation. This paper tries to use data to analyze the causes and essence of international labor standards under trade liberalization through empirical analysis. Countermeasures. Objective analysis of the impact of international labor standards on China's foreign trade and the actual situation of international labour standards in China, and based on the imperfect domestic legislative system, the lack of strict enforcement of the law and other legal aspects of the analysis, It is hoped that this paper can provide useful help and reference to the practice of labor standards in China.
