【摘要】：跟單信用證作為當(dāng)今國(guó)際貿(mào)易中最常用的支付方式,其“國(guó)際商業(yè)的生命血液”的稱號(hào)當(dāng)之無愧。信用證是商人們的偉大創(chuàng)造,是一種商業(yè)慣例。在長(zhǎng)期的發(fā)展過程中,信用證商業(yè)慣例與法律制度相互作用,一并豐富和發(fā)展。然而,隨著信用證交易的迅速發(fā)展,信用證欺詐的問題也日漸泛濫。原因就在于與信用證相關(guān)的法律制度的不完善。 我國(guó)作為世界上的貿(mào)易大國(guó),與信用證相關(guān)的法律制度卻存在諸多不足,進(jìn)而導(dǎo)致我國(guó)法院及商業(yè)銀行的國(guó)際信譽(yù)受損。筆者通過對(duì)我國(guó)信用證法律制度中存在的問題及解決建議的論述,以期為我國(guó)對(duì)外貿(mào)易的持續(xù)健康發(fā)展貢獻(xiàn)綿薄之力。
[Abstract]:Documentary credit, as the most commonly used payment method in international trade, deserves the title of "life blood of international commerce". The letter of credit is the great creation of merchants, is a commercial practice. In the long-term development process, However, with the rapid development of the letter of credit transaction, the problem of letter of credit fraud is becoming more and more widespread. The reason lies in the imperfect legal system related to the letter of credit. China, as a big trading country in the world, has many shortcomings in its legal system related to letters of credit. The author discusses the problems existing in the legal system of our country's letter of credit and its solutions in order to contribute a little to the sustained and healthy development of our country's foreign trade.
