【摘要】:隨著歐盟內(nèi)部統(tǒng)一市場(chǎng)的形成,歐盟貨物自由流動(dòng)原則在歐盟法中凸顯出其重要性,,是支撐歐洲聯(lián)盟的基礎(chǔ)性原則。在貨物自由流動(dòng)原則的推動(dòng)下,歐盟逐步實(shí)現(xiàn)了貨物在歐盟境內(nèi)的自由貿(mào)易,并隨之帶動(dòng)服務(wù)、資本和人員在歐盟境內(nèi)的自由流動(dòng),從而鞏固了歐盟內(nèi)部市場(chǎng)。而目前,中國(guó)-東盟自由貿(mào)易區(qū)剛剛成立,歐盟貨物自由流動(dòng)原則在歐盟成功運(yùn)行的經(jīng)驗(yàn)對(duì)中國(guó)-東盟自由貿(mào)易區(qū)有重要的借鑒意義,學(xué)習(xí)歐盟推動(dòng)貨物自由流動(dòng)的經(jīng)驗(yàn),將有利于促進(jìn)中國(guó)與東盟各國(guó)之間的貨物自由流動(dòng)。 本文以歐盟貨物自由流動(dòng)原則為切入點(diǎn),主要目的是探討以下幾個(gè)問(wèn)題:《歐盟運(yùn)行條約》第34條、第35條、第36條的適用范圍?如何運(yùn)用《歐盟運(yùn)行條約》第34條、第35條、第36條來(lái)保障歐盟貨物自由流動(dòng)原則?歐盟貨物自由流動(dòng)原則對(duì)中國(guó)-東盟自由貿(mào)易區(qū)的啟示? 本文除引言和結(jié)語(yǔ)外,共分成六個(gè)部分,三萬(wàn)四千余字。 第一部分:介紹歐盟貨物自由流動(dòng)原則的歷史發(fā)展。分析歐盟貨物自由流動(dòng)原則在歐盟內(nèi)部市場(chǎng)的地位,以及它對(duì)于掃除歐盟貨物流動(dòng)障礙的重要作用,并指出研究歐盟貨物自由流動(dòng)原則是十分必要的。 第二部分:分析歐盟關(guān)于貨物自由流動(dòng)的一般性規(guī)定。貨物的定義、跨境交易、收貨方等這些規(guī)定普遍適用于第34條、第35條以及第36條。 第三部分:分析《歐盟運(yùn)行條約》第34條的內(nèi)容與適用范圍。第34條作為基礎(chǔ)性條款,主要規(guī)制成員國(guó)以不正當(dāng)方式限制從其他成員國(guó)進(jìn)口貨物的行為,其適用的范圍決定了歐盟貨物自由流動(dòng)原則的適用范圍。同時(shí),結(jié)合歐盟法院的經(jīng)典案例,對(duì)進(jìn)口數(shù)量限制以及與進(jìn)口數(shù)量限制有同等效果的措施、銷售安排、互相認(rèn)可原則以及典型的貿(mào)易壁壘進(jìn)行解釋和說(shuō)明。 第四部分:分析《歐盟運(yùn)行條約》第35條的內(nèi)容與適用范圍。第35條主要禁止成員國(guó)以不正當(dāng)方式限制貨物從一個(gè)成員國(guó)出口到其他成員國(guó),根據(jù)歐盟案例法的發(fā)展,對(duì)第35條的解釋也隨之變化。 第五部分:主要分析歐盟貨物自由流動(dòng)原則的除外適用。這些除外適用的理由能幫助成員國(guó)合理規(guī)避《歐盟運(yùn)行條約》第34條和第35條的適用。只有基于《歐盟運(yùn)行條約》第36條和強(qiáng)制性要求這兩項(xiàng)下的內(nèi)容,才能合法排除歐盟貨物自由流動(dòng)原則的適用。 第六部分:歐盟貨物自由流動(dòng)原則對(duì)中國(guó)-東盟自由貿(mào)易區(qū)的啟示。通過(guò)對(duì)歐盟貨物自由流動(dòng)原則的研究,進(jìn)一步探討剛成立的中國(guó)-東盟自由貿(mào)易區(qū)如何借鑒歐盟的成功經(jīng)驗(yàn),并就此問(wèn)題提出幾點(diǎn)建議。
[Abstract]:With the formation of the unified market within the European Union, the principle of free movement of goods in the EU law highlights its importance and is the basic principle that underpins the European Union, and is promoted by the principle of free movement of goods. The EU has gradually realized the free trade of goods within the EU, and with it the free movement of services, capital and people within the EU, thus consolidating the internal market of the EU. And at present, the China-ASEAN Free Trade area has just been established. The successful operation of the principle of free flow of goods in the EU is of great significance to the China-ASEAN Free Trade area, and learn from the experience of the EU in promoting the free flow of goods. It will facilitate the free flow of goods between China and ASEAN countries. This paper focuses on the principle of the free movement of goods in the European Union. The main purpose of this paper is to explore the following issues: the scope of application of Article 34, Article 35, Article 36 of the EU operational Treaty? How to apply Article 34, Article 35, Article 36 of the EU operational Treaty to guarantee the principle of free movement of goods in the EU? The Enlightenment of the principle of Free Movement of goods from the EU to China-ASEAN Free Trade area? In addition to the introduction and conclusion, this article is divided into six parts, more than 34,000 words. The first part introduces the historical development of the principle of free movement of goods in the European Union, analyzes the position of the principle of free movement of goods in the internal market of the European Union, and its important role in removing obstacles to the movement of goods in the European Union. It is pointed out that it is necessary to study the principle of free movement of goods in EU. Part II: analysis of the EU's general provisions on the free movement of goods. Definition of goods, cross-border transactions, recipients, etc. These provisions are generally applicable to articles 34, 35 and 36. The third part: analysis of the content and scope of application of Article 34 of the EU operational Treaty. As a basic provision, Article 34 mainly regulates the behavior of member States in restricting the import of goods from other member States in an improper manner. The scope of its application determines the scope of application of the principle of free movement of goods in the European Union. At the same time, combined with the classic case of the European Court of Justice, sales arrangements are arranged for import quantity restrictions and measures that have the same effect as import volume restrictions. Mutual acceptance principle and typical trade barriers are explained and explained. Part 4th: analysis of the content and scope of application of Article 35 of the Treaty on the Operation of the EU. Article 35 mainly prohibits member States from unduly restricting the export of goods from one member State to other member States, according to the development of EU case law. The interpretation of article 35 has changed accordingly. Part 5th: mainly analyzes the exclusion application of the EU principle of free movement of goods. The reasons for these exclusions can help member States to reasonably circumvent the application of articles 34 and 35 of the EU operational Treaty. Under article 36 of the Treaty and the mandatory requirements, In order to legally exclude the application of the EU principle of free movement of goods. Part 6th: the enlightenment of the principle of free flow of goods from the EU to China-ASEAN Free Trade area. Through the study of the principle of free movement of goods in the EU, This paper further discusses how the newly established China-ASEAN Free Trade area draws lessons from the successful experience of the European Union and puts forward some suggestions on this issue.
