【摘要】：腐敗是古今中外任何社會制度下都存在的問題之一，已經(jīng)嚴(yán)重影響到人民生活和政權(quán)及社會穩(wěn)定。反腐敗成功與否是關(guān)系到國家興亡、社會穩(wěn)定和人民生活的大事。20世紀(jì)末，透明國際提出了“國家廉政體系”理論，它打破了政府是治理腐敗的唯一合法力量的傳統(tǒng)觀念，對反腐敗理論的發(fā)展產(chǎn)生了重要和深遠(yuǎn)的影響。為了國際社會共同打擊腐敗犯罪，聯(lián)合會大會全體會議于2003年第58屆審議通過了《聯(lián)合國反腐敗公約》（以下簡稱《公約》），2005年10月我國審議并批準(zhǔn)了《公約》。它的產(chǎn)生和生效有利于世界各國反腐敗斗爭的深入開展和國際反腐敗的統(tǒng)一戰(zhàn)線的形成及鞏固。當(dāng)前，我國要以履行《公約》為契機(jī)，落實(shí)《公約》的相關(guān)條款，繼續(xù)完善中國特色的國家廉政體系，推進(jìn)反腐倡廉工作的進(jìn)一步發(fā)展。 本文通過研究國家廉政體系的基礎(chǔ)理論，以《公約》所構(gòu)建的國家廉政體系為視角，，通過分析我國國家廉政體系現(xiàn)狀及缺陷，提出我國國家廉政體系與《公約》的銜接及完善對策。 本文首先介紹了研究背景，并綜述國內(nèi)外研究現(xiàn)狀，簡要概括了研究內(nèi)容及研究方法，接下來闡述了國家廉政體系理論產(chǎn)生的理論背景和現(xiàn)實(shí)背景，國家廉政體系的理論框架，并對國家廉政體系進(jìn)行了簡單的功能分析。其次，簡要概括了《公約》的主要內(nèi)容，并分析了《公約》所構(gòu)建的國家廉政體系。再次，通過介紹了我國國家廉政體系的演變及現(xiàn)狀，并對比《公約》所構(gòu)建的國家廉政體系論述了我國廉政體系的一些缺陷。最后提出一些落實(shí)《公約》以促進(jìn)我國國家廉政體系完善的對策。
[Abstract]:Corruption is one of the problems existing under any social system, and has seriously affected the life of the people, political power and social stability. The success of anti-corruption is a major event related to the rise and fall of the country, social stability and people's life at the end of the 20th century. Transparency International has put forward the "National Integrity system" theory, which breaks the traditional notion that government is the only legitimate force in the fight against corruption. Has had an important and far-reaching impact on the development of anti-corruption theories. In order to combat corruption crimes jointly by the international community, The General Assembly of the Federation adopted the United Nations Convention against Corruption (hereinafter referred to as the Convention) at its 58th session in 2003. In October 2005, China reviewed and ratified the Convention. Its birth and entry into force are conducive to the fight against corruption in all countries of the world. The deepening of the struggle and the formation and consolidation of the international United front against corruption. China should take the implementation of the Convention as an opportunity, implement the relevant articles of the Convention, continue to improve the national clean government system with Chinese characteristics, and promote the further development of anti-corruption work. By studying the basic theory of the national clean government system and taking the national clean government system constructed by the Convention as the angle of view, this paper analyzes the present situation and defects of the national clean government system in our country. The paper puts forward the linking and perfecting countermeasures of our country's clean government system and the Convention. This paper first introduces the research background, and summarizes the current research situation at home and abroad, briefly summarizes the research content and research methods, and then expounds the theoretical background and practical background of the theory of national clean government system. The theoretical framework of the national clean government system, and a simple functional analysis of the national clean government system. Secondly, briefly summarized the main contents of the Convention, and analyzed the national clean government system constructed by the Convention. By introducing the evolution and present situation of our country's clean government system, Compared with the national clean government system constructed by the Convention, this paper discusses some defects of our country's clean government system, and finally puts forward some countermeasures to promote the perfection of our country's clean government system by implementing the Convention.
