【摘要】：貿(mào)易與安全問題向來是國際法的阿克琉斯之踵。WTO協(xié)定試圖在自由貿(mào)易與國家安全之間劃定一條平衡線。在安全例外條款中,雖然締約方被賦予一定程度的自裁決權,然而根據(jù)善意原則,締約方應以國際公法的慣常解釋規(guī)則進行條約解釋與適用。在理論上,"重要安全利益"自動地包含超越"一般安全利益至上"的網(wǎng)絡安全;同時,"戰(zhàn)時"與"國際關系緊急情況"將自動拓展至網(wǎng)絡空間。由此,以網(wǎng)絡安全為由的貿(mào)易限制措施應滿足國家安全例外條款。作為貿(mào)易大國,我國應合理利用安全例外條款保障我國的網(wǎng)絡安全,并以貿(mào)易規(guī)則合法地對抗西方國家對我國產(chǎn)品的國家安全審查。
[Abstract]:Trade and security issues have always been the Achilles heel of international law. The WTO Agreement seeks to draw a balance between free trade and national security. In the security exception clause, although the parties are given a degree of discretion, However, according to the principle of good faith, parties should interpret and apply treaties according to the customary rules of interpretation of public international law. In theory, "important security interests" automatically include cybersecurity beyond "general security interests first"; At the same time, "wartime" and "international relations emergency" will automatically be extended to cyberspace. Therefore, trade restrictions on the grounds of cybersecurity should meet the national security exception clause. Our country should make use of the security exception clause reasonably to protect our network security, and legally confront the national security review of our products by the trade rules.
