【摘要】：流浪權(quán)既是流浪者的一種精神權(quán)利,也是其物質(zhì)—生活權(quán)利。兩類權(quán)利在流浪行為中相互交織,相互影響。其無論在法定形態(tài)上,還是在習(xí)慣事實上,都有所表現(xiàn)。與此相應(yīng),也必然要求流浪者負(fù)有相應(yīng)的義務(wù)。其中既有和流浪之生活權(quán)利相應(yīng)的流浪義務(wù),也有和流浪之精神權(quán)利相應(yīng)的流浪義務(wù)。在表現(xiàn)形式上,無論何種流浪義務(wù),都可二分為法定的或者習(xí)慣的義務(wù)。經(jīng)由流浪義務(wù)的探討,再回過頭來看待流浪權(quán)利,會發(fā)現(xiàn)兩者在流浪行為中,具有明顯的精神—生活交互性。
[Abstract]:The right to vagrancy is not only a spiritual right but also a material-life right of a homeless person. The two rights are intertwined and interacted with each other in vagrancy. It must also require the homeless to bear the corresponding obligations. Among them, there are the vagrancy obligations corresponding to the right to live and the spiritual rights of vagrancy. In the form of expression, no matter what kind of obligation of vagrancy, Both can be divided into legal or customary obligations. Through the study of the obligation of vagrancy, and then looking back on the right of vagrancy, we can find that both of them have obvious spirit-life interaction in the vagrancy behavior.
