【摘要】：全文除引言和結(jié)語(yǔ)外共分為五部分,總的來(lái)說(shuō)可分為兩個(gè)大方面：第一方面,通過(guò)對(duì)引渡的概念、引渡的歷史以及現(xiàn)代引渡制度的內(nèi)容、國(guó)際引渡合作的新發(fā)展的梳理,勾勒引渡制度的全貌；第二方面,通過(guò)對(duì)我國(guó)當(dāng)前引渡立法和司法實(shí)踐進(jìn)行考察,論述我國(guó)引渡立法方面的成就和在司法實(shí)踐中存在不足,在此基礎(chǔ)上有針對(duì)性的提出了能動(dòng)司法在我國(guó)實(shí)行的路徑選擇。 第一部分,引渡的概念分析與歷史考證。本部分首先在給出引渡概念,并分析了引渡的特征與性質(zhì),接著對(duì)引渡的歷史發(fā)展進(jìn)行了分析,豐富和加深引渡概念的理解與把握。 第二部分,現(xiàn)代引渡制度的基本內(nèi)容。本部分從引渡的主體、引渡的依據(jù)、引渡的原則、引渡的程序四個(gè)方面分析了現(xiàn)代引渡制度的基本內(nèi)容。 第三部分,國(guó)際引渡合作規(guī)則的新發(fā)展。本部分對(duì)隨著國(guó)際間的引渡合作的廣泛開(kāi)展所出現(xiàn)新的引渡合作規(guī)則進(jìn)行了總結(jié)與歸納,主要包括放棄或者變通引渡問(wèn)題上的“條約前置主義”、在國(guó)際引渡案例中,對(duì)于“政治犯不引渡”這一原則的適用愈來(lái)愈加以限制、而“死刑不引渡”原則成為司法實(shí)踐中的剛性原則已成為不爭(zhēng)的事實(shí)、關(guān)于本國(guó)國(guó)民引渡的限制不斷放寬、鼓勵(lì)運(yùn)用簡(jiǎn)易引渡程序。 第四部分,我國(guó)引渡立法與司法實(shí)踐狀況考察。本部分從我國(guó)參加的國(guó)際條約、我國(guó)《引渡法》的主要內(nèi)容、我國(guó)引渡立法與實(shí)踐存在問(wèn)題三個(gè)方面分析我國(guó)引渡方面的成就與不足。 第五部分,完善我國(guó)引渡立法與司法實(shí)踐的對(duì)策。本部分引渡的原則、引渡的程序、梳理相關(guān)法律間的關(guān)系、引渡案件審查權(quán)的歸屬等方面探討了我國(guó)引渡立法與司法實(shí)踐中的完善建議。
[Abstract]:In addition to the introduction and conclusion, the full text is divided into five parts. In general, it can be divided into two major aspects: first, by combing the concept of extradition, the history of extradition and the content of modern extradition system, the new development of international extradition cooperation. The second aspect, through the investigation of the current extradition legislation and judicial practice, discusses the achievements of our extradition legislation and the shortcomings in the judicial practice. On this basis, it puts forward the path choice of active justice in our country. The first part, the concept analysis and historical textual research of extradition. This part first gives the concept of extradition, analyzes the characteristics and nature of extradition, then analyzes the historical development of extradition, enriches and deepens the understanding and grasp of the concept of extradition. The third part, the new development of the international extradition cooperation rules. Mainly including renunciation or adaptation of "treaty preemption" on extradition, in international extradition cases, the application of the principle of "non-extradition of political prisoners" has been increasingly restricted. The restriction on extradition of nationals has been relaxed constantly, and the use of summary extradition procedure is encouraged. Part 4th, the investigation of the legislation and judicial practice of extradition in our country, the main contents of the extradition Law of our country from the international treaties to which our country is a party, This paper analyzes the achievements and shortcomings of extradition in China from three aspects: the problems in the legislation and practice of extradition. Part 5th, perfect our country extradition legislation and judicial practice countermeasure, this part extradition principle, extradition procedure, comb the relation between relevant laws, The author probes into the perfection of extradition legislation and judicial practice in the aspects of the attribution of the right to examine extradition cases.
