【摘要】：當(dāng)前的國(guó)際船舶油污損害賠償機(jī)制是以《1969年國(guó)際油污損害民事責(zé)任公約》和《1971年建立國(guó)際油污損害賠償基金公約》以及二者的一系列議定書(shū)為基礎(chǔ)建立起來(lái)的。為了適應(yīng)國(guó)際海運(yùn)的發(fā)展和損害后果日益嚴(yán)重的船舶油污事件的需要,其內(nèi)容隨著公約的修訂而不斷變化。而每次修訂所導(dǎo)致的最重要的變化就是油污損害賠償限額的逐漸提高,導(dǎo)致了對(duì)于是否應(yīng)該設(shè)置賠償限額以及該機(jī)制適用性的質(zhì)疑。另外,船舶油污損害賠償責(zé)任主體的排他性、油污損害賠償范圍的局限性、國(guó)際船舶油污損害賠償機(jī)制參加國(guó)的局限性也是導(dǎo)致該國(guó)際機(jī)制適用性瑕疵的重要原因。應(yīng)當(dāng)擴(kuò)大船舶油污損害賠償、責(zé)任主體及機(jī)制參加國(guó)的范圍,設(shè)置合理的賠償限額,提高國(guó)際船舶油污損害賠償機(jī)制的適用性和完整性。
[Abstract]:The current international compensation mechanism for oil pollution damage from ships is based on the International Convention on Civil liability for Oil pollution damage of 1969, the Convention on the Establishment of the International Oil pollution compensation Fund of 1971 and a series of protocols between them. In order to meet the needs of the development of international maritime transport and the increasingly serious consequences of damage caused by oil pollution from ships, Its content has evolved with the amendment of the Convention. The most important change resulting from each revision is the gradual increase in the limit of compensation for oil pollution damage, which has led to questions as to whether the compensation limit should be set and the applicability of the mechanism... The exclusiveness of the main body of liability for oil pollution damage and the limitation of the scope of compensation for oil pollution damage, The limitation of the participating countries of the international mechanism for compensation for oil pollution damage is also an important reason for the defects in the applicability of the international mechanism. The scope of compensation for oil pollution damage caused by ships should be expanded, and the scope of the subject of liability and the participating countries of the mechanism should be expanded, and a reasonable limit of compensation should be set. To improve the applicability and integrity of the compensation mechanism for oil pollution damage caused by international ships.
