【摘要】：外層空間軍事化的內(nèi)涵包括軍事化利用人造衛(wèi)星和外層空間武器化兩種情形。國際法對外層空間軍事化的規(guī)制,應(yīng)當(dāng)根據(jù)這兩種情形而采取相應(yīng)的具體模式。既有的國際條約法不能夠充分地、有效地對外層空間軍事化進(jìn)行規(guī)制,未能禁止外層空間武器化活動,完善國際條約法又面臨著諸多難以克服的困難。建立禁止外層空間武器化活動的國際習(xí)慣法規(guī)則應(yīng)當(dāng)是實現(xiàn)國際法對外層空間軍事化規(guī)制的理想路徑。禁止外層空間武器化活動的實踐行為已經(jīng)基本符合構(gòu)成國際習(xí)慣法的物質(zhì)要素,即國家實踐的要求,但在心理要素即法律確信方面還有所缺失。國際社會應(yīng)當(dāng)采取積極主動的方式促成這一國際習(xí)慣法規(guī)則的建立
[Abstract]:The militarization of outer space includes the militarization of the use of artificial satellites and the weaponization of outer space. The existing international treaty law does not adequately and effectively regulate the militarization of outer space and does not prohibit the weaponization of outer space, The establishment of the rules of international customary law prohibiting the weaponization of outer space should be the ideal way to regulate the militarization of outer space in international law. The practice of weaponization activities in space has largely complied with the material elements that constitute customary international law, That is, the requirements of state practice, but there are still some deficiencies in psychological elements, that is, opinio juris. The international community should take a proactive approach to promote the establishment of this rule of international customary law.
